Claiming a personal exemption, you went ahead and filed your taxes before your parents had a chance to file. But your parents want to claim you as a dependent on their taxes. When you did your taxes, you failed to check the box on the 1040 that says you could be claimed as a dependent on someones elses taxes.

Now your parents cannot claim you as a dependent on their taxes. If your parents can claim you on their taxes and you agree they should youll need to file an amendment.

When Can I File An Amended Return

You must wait until the IRS has processed your tax return before making corrections. If you are expecting a tax refund, wait until you receive it before filing an amended return.

An amended return can be filed either within 3 years after the date you filed your original return or within 2 years after the date you paid any tax owed, whichever comes later.

If you discover an error after filing your return, you may need to amend your return. The IRS may correct mathematical, clerical errors on a return and may accept returns without certain required forms or schedules. In these instances, there’s no need to amend your return. However, do file an amended return if there’s a change in your filing status, income, deductions, credits or tax liability. Use Form 1040-X, Amended U.S. Individual Income Tax Return to correct a previously filed Form 1040, Form 1040-SR, Form 1040-A, Form 1040-EZ, Form 1040-NR, Form 1040-NR-EZ, or to change amounts previously adjusted by the IRS. You can also use Form 1040-X to make a claim for a carryback due to a loss or unused credit however, you may also be able to use Form 1045, Application for Tentative Refund instead of Form 1040-X. Amending An Individual Income Tax Return

Individual income tax returns from 2009 and forward may be amended electronically through Revenue Online. Filing and amending returns in Revenue Online is a free service. You may amend online even if the original return was filed on paper. Revenue Online has all the information from your original return. You will not need to re-enter everything.

If you cannot amend online, you may file the DR 0104X. Make sure you use the appropriate form version for the year you are amending. If you are changing your Colorado return because the IRS made changes to your federal return, you must file the DR 0104X within 30 days of being notified by the IRS. You must amend your Colorado return in this case, even if there is no net change to your tax liability. It is very important that you submit all schedules and supporting documentation for any changes with your amended return. You must submit all schedules, even if you are not changing those values.

Keep An Eye On The Calendar

Generally, the IRS audits only returns from the previous three tax years though there are major exceptions. So although it might be tempting to wait and see if the IRS will catch you in an error, it might be cheaper to fess up sooner rather than later.

The IRS charges interest and penalties on outstanding tax liabilities going all the way back to the original due date of the tax payment. So the longer you wait to fix a mistake, the more expensive that mistake can get.

What Is An Informal Refund Claim

The IRS provides tax forms for most amended tax returns. You do not always have to use these tax forms. In fact, the courts have said that several other documents sent to the IRS are informal refund claims.

The courts have put limits on what counts as an informal refund claim. Generally, the claim has to be in writing and it has to provide sufficient information as to your tax liability for the year to allow the IRS to decide whether it wants to conduct an audit. This means that it has to state the factual and legal bases for the refund claim.

With that said, you should not plan on submitting an informal refund claim. The risk is too great that the IRS and/or courts may conclude that it was insufficient. It is better practice to simply use the IRSs forms where possible.

You can see how this goes in court cases that address informal refund claims. These cases usually cite various letters and documents sent to the IRS prior to the IRS making an unfavorable adjustment . The taxpayers then go back and try to sue the IRS for a refund, and have to argue that these prior documents were refund claims that were denied by the IRS. This is required as an amended tax return is a prerequisite to being able to sue the IRS for a refund.

What Is The Deadline For Filing An Amended Tax Return

If you expect a refund on your amended tax return, the deadline is generally three years from the original tax deadline or two years after taxes were paid for that year whatever date is later.

If you discover a mistake or omission on your return that would require you to have to pay more to the IRS, you should still file as soon as possible to reduce or avoid tax penalties and interest. If you e-filed your original return, give it time to be processed before you amend. Also, if you are expecting a tax refund, wait for the IRS to clear the refund before you submit your amended return. You can check the status of your return by going to Get Your Refund Status. The IRS can generally assess additional tax and penalties three years after a return is due or filed, whichever is later. However, some situations have longer assessment periods.

Amended Returns Must Be Filed By Paper For The Following Reasons:

    Is There A Time Limit For Amending A Return

    The IRS advises that you generally must file Form 1040X to amend a return within three years from the date you filed your original tax return, or within two years of the date you paid the tax, whichever is later. Be sure to enter the year of the return you are amending at the top of Form 1040X.

    If you miss the deadline, the IRS may not let you amend your return and you could miss out on any deductions, credits or tax benefits the amendment would allow you to claim.     The IRS will correct common errors during processing. However, there are certain situations in which a taxpayer may need to file an amended return to make a correction. Taxpayers can now file amended returns electronically. Here are some tips for anyone who discovered they made a mistake or forgot to include something on their tax return.

    Use the Interactive Tax Assistant. Taxpayers can use the Should I file an amended return? to help determine if they should file an amended tax return.

    Don’t amend for math errors or missing forms. Taxpayers generally don’t need to file an amended return to correct math errors on their original return. The IRS may correct math or clerical errors on a return and may accept it even if the taxpayer forgot to attach certain tax forms or schedules. The IRS will mail a letter to the taxpayer, if necessary, requesting additional information.

    Wait until receiving refund for tax year 2019 before filing. Taxpayers who are due refunds from their original tax year 2019 tax return should wait for the IRS to process the return and they receive the refund before filing Form 1040-X to claim an additional refund.

    Pay additional tax. Taxpayers who will owe more tax should file Form 1040-X and pay the tax as soon as possible to avoid penalties and interest. They should consider using IRS Direct Pay to pay any tax directly from a checking or savings account for free.

    Your Employer Made A Mistake On Your W

    People make mistakes, and so do companies. If the payroll department made an error on your W-2, itll have to send you a corrected form. When you receive the new W-2C it will display the previously reported information next to the correct information to let you know what needs to be corrected. If the numbers changed and you already filed your return using the incorrect W-2, you will have to file an amendment.

    You Forgot To Report Income From A Side Gig

    You worked a side gig but had no idea you had to report the extra income on your federal income tax return. You went ahead and filed your taxes, but later you received a CP2000 notice from the IRS alerting you that the information the IRS has on file doesnt match what you reported on your tax return. In this case, you may have underpaid your taxes.

    The notice shows the side gig income that you forgot to report. If the information in the CP2000 is correct, you dont need to amend your return unless you have additional income, credits or expenses to report.

    In this case, you agree with the notice but also had expenses that need to be deducted. So youll have to file an amendment.

    To deduct your side-gig expenses, fill out a Schedule C for the side gig and file a 1040X. You will also want to write CP2000 on top of your amended return, attach it to the response form, then mail it to the IRS.

    You can check the status of your Form 1040-X, Amended U.S. Individual Income Tax Return using the Wheres My Amended Return? online tool or the toll-free telephone number 464-2050 three weeks after you file your amended tax return. Both methods are available in English and Spanish and track the status of amended tax returns for the current year and up to three prior years.

    Please keep in mind that due to Coronavirus processing delays, amended returns may take longer than three weeks to appear in IRS system and up to 20 weeks to process. Before that time, theres no need to call IRS unless the online tool specifically tells you to do so.

    What Forms Are Required With An Electronically Filed Amended Return

    The electronic Form 1040, 1040-SR, and 1040-NR Amended Returns will require submission of ALL necessary forms and schedules as if it were the original submission, even though some forms may have no adjustments.

    The Form 1040-SS/PR Corrected returns will require submission of ALL necessary forms and schedules as if it were the original submission, even though some forms may have no adjustments. Note that Form 1040-X will not be attached to Form 1040-SS/PR.

    If You Must Amend Your Return

    If you need to make a change or adjustment on a return already filed, you can file an amended return. Use Form 1040-X, Amended U.S. Individual Income Tax Return, and follow the instructions.

    You should amend your return if you reported certain items incorrectly on the original return, such as filing status, dependents, total income, deductions or credits.

    However, you dont have to amend a return because of math errors you made the IRS will correct those. You also usually wont have to file an amended return because you forgot to include forms, such as W-2s or schedules, when you filed the IRS will normally request those forms from you.
