How to File Taxes After Receiving Unemployment

If you had any unemployment income last year, it is subject to taxes and needs to be reported on your 2020 income tax return. In January, those who had unemployment income should have received a Form 1099-G that spells out the amount of money paid out during the year.

Federal income taxes apply to these benefits whether it’s state unemployment insurance or the pandemic unemployment compensation disbursed under the CARES Act.

The catch is that withholding the appropriate amount of income tax is voluntary. You can opt to have a flat 10% of your benefits withheld to cover the tax liability.

In order to do this, you’d have to file Form W-V4 with the state agency administering your unemployment.

You can also choose to make quarterly estimated tax payments to the IRS.

Uncle Sam isn’t the only entity seeking a slice of your unemployment income. Most states will tax these benefits, too.

A handful of states Alabama, California, Montana, New Jersey, Pennsylvania and Virginia don’t tax these payments. Indiana and Wisconsin offer a partial exclusion of unemployment income, according to Andy Phillips, director at the Tax Institute at H& R Block.

“Some states have withholding, and others require it in order to alleviate surprises when tax time comes around,” said Jared Walczak, vice president of state projects at the Tax Foundation.

How To Prepare For Your 2021 Tax Bill

You have the option of having income tax withheld from your unemployment benefits so you dont have to pay it all at once when you file your tax returnbut it wont happen automatically. You must complete and submit Form W-4V to the authority thats paying your benefits. Withheld amounts appear in box 4 of your Form 1099-G.

Federal law limits the amount you can have withheld from benefits to 10%. This may not be enough to adequately cover taxes on the benefits you received. If youve returned to work, you can opt to have extra tax withheld from your paychecks through the end of the year to help cover taxes owed on your unemployment benefits as well as your regular pay.

Your other option is to make advance estimated quarterly payments of any tax you think you might owe on your benefits. You have until Jan. 15, to make estimated tax payments on any benefits you receive between September and December the prior tax year. In fact, you must do so if sufficient tax wasnt withheld from your unemployment benefit payments. You could be charged a tax penalty if you dont pay as you go through either additional withholding or estimated payments during the tax year.

The tax you owe on your unemployment benefits might be minimal depending on how much you received. This is because unemployment doesn’t replace 100% of your previously earned compensation.

  • Severance pay is a lump-sum payment received from a company when you are terminated due to job closings, company reductions, or even company closures. These payments are typically based on time in service and/or job performance, and as such are taxable as wages. This payment will have the usually Social Security, Medicare, federal and state taxes withheld, which will be reflected on your W-2.

Do You Owe Taxes On Unemployment Benefits

Yes, unemployment checks are taxable income. If you received unemployment benefits in 2020, it counts as part of your income, and thus you will owe income taxes on that amount. Your benefits may even raise you into a higher income tax bracket, though you shouldnt worry too much about getting into a higher tax bracket.

Some workers received additional unemployment benefits in 2020 due to provisions in federal and state laws as a result of the coronavirus pandemic. Those additional benefits are also taxable income. If you received extra unemployment in 2020, it also counts as part of your income, and you will owe income taxes on that, too.

People who file for unemployment have the option to have income taxes withheld from their unemployment checks, and many do. If you elected to do this, you have little to worry about.

What if you didnt elect to have income taxes withheld from your unemployment checks? Dont panic. Although youll see a higher tax bill this year, if you were employed during much of the year, you may simply see a reduced tax return or a very small tax bill when you file.

Requesting A Duplicate 1099

If you do not receive your Form 1099-G by February 1, and you received unemployment benefits during the prior calendar year, you may request a duplicate 1099-G form by phone:

  • Call Tele-Serv at 800-558-8321.
  • Select option 2 and follow the prompts.
  • We cannot process requests for duplicate 1099-G forms until after February 1 because throughout January we are still mailing the original forms.

    You do not need a paper copy of Form 1099-G to file your federal tax return the IRS only needs the total amount of benefits TWC paid you during the previous calendar year and the amount of taxes withheld.

    With current individual tax rates ranging from 10% to 37%, the potential tax savings can vary from $1,020 to $3,825, Johnson says. The amount, of course, depends on the taxpayers filing status, income and other factors, such as deductions claimed on the tax return.

    For example, if you qualify for the $10,200 tax break, youre single and are in the 22% tax bracket, you may qualify for a tax savings of $2,244. And if you are married and both you and your spouse qualify for the tax break, you may be able to save $4,488.

    The New York State Department of Taxation and Finance today encouraged New Yorkers to review their current tax situation. By taking a closer look at your tax records now, you can ensure you dont end up owing unpaid taxes, and you may be able to claim valuable tax credits when you file your income tax return next year.

    We understand many New York taxpayers are facing challenges this year, which is why were reminding them of all the money-saving tax programs and refundable tax credits available, said New York State Commissioner of Taxation and Finance Mike Schmidt. We also want taxpayers to understand that unemployment insurance payments are taxable. As a result, some taxpayers may need to adjust their withholding to prevent a tax bill in 2021.

    Unemployment benefits are taxable benefits

    If you are receiving unemployment benefits, consider having tax withheld from these payments to avoid owing taxes when you file your federal and New York State income tax return next year. New York State unemployment insurance benefits and any of the special unemployment compensation authorized under the Coronavirus Relief Act are considered taxable income. By law, the New York State Department of Labor must report these benefits to the IRS and to the New York State Tax Department.

    If you received unemployment benefits in 2020, EDD should have already sent you your 1099G form, which is a record of the total taxable income EDD has issued to you in a calendar year.

    If you havent gotten this form for some reason, you can print one or request a paper copy through your UI Online account on EDDs website.

    EDD recommends that if your 1099G form shows a $0 amount, you should call 1-866-401-2849 You can also report form problems online.

    The COVID-19 pandemic has disrupted many parts of our lives. But there’s one annual ritual you still can’t escape: paying your taxes.

    For millions of Californians, this year’s tax return will include a less common form of income — unemployment benefits.

    Taxes can be confusing even in the best of times. And only more so if you spent last year in-and-out of work, collecting income from multiple sources, including California’s unemployment agency.

    We’ve put some common questions about unemployment benefits to tax experts in Los Angeles. Hopefully these answers will make filing a bit easier after a tough year.

    Wait… I have to pay taxes on my unemployment benefits?

    Yes, unemployment benefits are taxable. This can understandably come as a shock to those who find the whole unemployment system confusing. But unemployment checks are considered income, and you’ll have to report that money when you file.

    But there’s good news if you live in California. Of all the states that levy a state income tax, only a handful exclude unemployment benefits, and California is one of them. However, federal income tax still applies.

    How much you owe will depend on how much income you collected last year — from unemployment, W2 employment, freelancing, investments, etc. — and what tax bracket you fall under based on that income.

    Planning For 2021 Taxes If Youre Still Unemployed

    The tax exemption for $10,200 in unemployment benefits currently only applies to unemployment income you collected in 2020, even though the bill also extended weekly $300 federal unemployment benefits payments through September.

    You should consider any unemployment benefits you receive in 2021 as fully taxable. If you can afford to do so, avoid a surprise bill and penalties next tax season by electing to have taxes withheld from your weekly benefits payments or by paying quarterly estimated taxes throughout the year.

    You can elect to have 10% of your unemployment benefits withheld from your weekly check. Even if you did not select this withholding on your original claim, you can file Form W-4V with your states unemployment office to begin 10% tax withholding on future unemployment payments.

    You can also forgo automatic withholding and instead pay estimated quarterly taxes on your unemployment income. Use Form 1040-ES to figure and file your quarterly payments. If you choose to pay estimated taxes on your unemployment benefits, the first payment is due April 15, 2021.

    How Do I Report Futa Tax To The Irs

    If you received unemployment benefits you could owe taxes ...

    At the end of each year, you must complete Form 940. The form asks you to calculate the total you owe for the previous year and the amount you have already paid. You must submit the balance to the IRS, along with Form 940, by January 31 of the following year.     How Do I Calculate Futa Taxes

    For each payroll, you must determine FUTA taxes payable based on the total gross pay paid to employees, up to $7,000 per employee each year. Then multiply this total by the FUTA tax rate .

    After you calculate the total tax for all employees for the pay period, you must set aside that total in a payables account in your accounting system. Unemployment tax is a trust fund tax, meaning that it is an amount you owe that must be paid to a government agency.

    Reporting Unemployment Benefits On Your Tax Return

    You report your unemployment compensation on Schedule 1 of your federal tax return in the Additional Income section. The amount will be carried to the main Form 1040. Remember to keep all of your forms, including any 1099-G form you receive, with your tax records.

    What To Do If You Have Not Filed Taxes

    If you havent already filed your 2020 tax return, you can claim the exemption allowed by the American Rescue Plan when you file.

    You can find all the information about what benefits you were paid and how much was withheld using Form 1099-G, which you should have received from your state unemployment office by mail or electronically. You may receive separate forms for state unemployment compensation and any federal benefits you received, but you should report all benefits you were paid on your return, according to the IRS.

    If you qualify, youll report your total benefits from Form 1099-G separately from the exclusion. Heres how:

    Generally, you report your taxes using Form 1040. But when you claim unemployment insurance, you must also complete a Schedule 1 form to report this additional income. Under the new exemption, you should report the total amount of unemployment compensation you received on line 7 of Schedule 1. Then, use the Unemployment Compensation Exclusion Worksheet to determine the exclusion amount youre eligible for, which youll report on line 8 of Schedule 1.

    If you work with a tax preparer to file, they should be able to assist you in working out what to report on these forms using IRS guidance. If you file using a tax software, the IRS says these changes should now be reflected in the software you use to prepare electronically.

    Paying Unemployment Taxes At The State And Local Level

    At the local and state level, the options to pay for your state and local taxes may differ depending on where you live. Contact your state, county, or local unemployment office to learn about the different options to pay your taxes. These options may include:

    1. Requesting to have state and/or local taxes withheld. The steps to request state and local tax withholding differ.

    2. Making quarterly estimated payments. The due dates for estimated payments at the state and local level may differ from federal due dates.

    3. Paying your taxes in full. If you need your full amount of your unemployment benefits and cannot make quarterly estimated payments, you can pay your taxes all at once when they are due. However, you may receive an underpayment penalty for not paying enough taxes throughout the year.

    Reporting Unemployment Benefits At The Federal Level

    For most states, you will receive Form 1099-G in the mail from your state unemployment office. Find out how you can obtain your 1099-G. On Form 1099-G:

    • In Box 1, you will see the total amount of unemployment benefits you received.
    • In Box 4, you will see the amount of federal income tax that was withheld.
    • In Box 11, you will see the amount of state income tax that was withheld.

    You dont need to attach Form 1099-G to your Form 1040 or Form 1040-SR.

    In certain states, you will not automatically be mailed a Form 1099-G. You will have to access your Form 1099-G online through your unemployment portal or call your state unemployment office to request that they mail your Form 1099-G. In other states, you will only be mailed a Form 1099-G if you selected that as your delivery preference.

    States that will not mail 1099-Gs at all Connecticut, Indiana, Missouri, New Jersey, New York, and Wisconsin
    States that will mail or electronically deliver 1099-Gs depending on which option you opted-into Florida, Illinois, Michigan, North Carolina, Rhode Island, Tennessee, and Utah

    If you received Form 1099-G, but didnt file for unemployment benefits, this may be a case of identity theft and fraud. Contact your state unemployment office immediately for additional information and how to report the potential fraud.

    Are Unemployment Benefits Through The Cares Act Taxable

    Under the CARES Act – the $2.2 trillion stimulus package – you can receive an additional 13 weeks of unemployment benefits. These benefits, which can help provide you with a total of 39 weeks of unemployment in most states, are called Pandemic Emergency Unemployment Compensation benefits. If your state provides less than 39 weeks of unemployment benefits, you can receive the difference through Pandemic Unemployment Assistance . Through July 31, 2020, you also can receive $600 each week in addition to the weekly unemployment benefits starting from the date you lose your job. These unemployment benefits are also subject to income tax at your ordinary income tax rate and will be added to your gross income.
