What To Do If You Owe Taxes On Unemployment Benefits

Explained: How To Report Unemployment on Taxes

After going through these steps, you may find that you owe taxes to the IRS. If you do, don’t panic. You have options.

However, not paying that tax bill is not one of those options. You should make every effort to pay as much of your tax bill as possible. Not paying your tax bill means that you’ll immediately face additional penalties for late payment, as well as interest that accrues on your unpaid taxes. If you continue to not file your taxes, the IRS may seek legal remedy against you.

Maintaining Eligibility For Your Unemployment Benefits

At this point, youve filed your claim with your states agency and have begun receiving benefits.

The next step is to follow your states procedures to continue receiving those benefits, if any. You could have to file weekly or biweekly claims after each week has ended, and/or respond to questions about your continued eligibility for unemployment benefits. If you do have to file these claims, they generally require information about specific earnings, job offers or job refusals. Generally, these claims are filed by mail or telephone. Your state will provide filing instructions.

Finally, you must report to your local Unemployment Insurance Claims Office or Career One-Stop/Employment Service Office for any day you were scheduled to do so by the agency. If you dont attend a scheduled interview, that could cause you to lose your benefits.

State Income Taxes On Unemployment Benefits

It may not be just the IRS you have to worry about. Many states tax unemployment benefits, too. There are several that do not, though California, Montana, New Jersey, Pennsylvania, and Virginia do not charge taxes on unemployment benefits. Arkansas and Maryland will not charge state taxes on unemployment benefits received in tax year 2021.

Eight states dont tax any income at all, so youll be spared if you live in Alaska, Florida, Nevada, South Dakota, Tennessee, Texas, Washington, or Wyoming. New Hampshire doesnt tax regular income it only taxes investment income.

Im Not A Tax Pro And This Is Not Tax Advice

Unemployment Tn Extra 300

Let me be clear: Im not a tax professional.

This is not meant to be tax advice. All Im doing here is providing information. Im trying to give you a bigger picture view of how taxes work and how they apply to you in your delivery business as you contract with Doordash, Uber Eats, Instacart, Grubhub, Postmates or any other delivery gigs.

I really really suggest you find a tax professional who understands self employment and gig economy taxes. They can look at your specific situation and help you out.

If Im not a tax pro, why would I put out a tax guide?

Because Im in the field. Im out there delivering like you are. And Ive dealt with self employed and business taxes for a number of years.

I figured that I could find the information that answers your tax questions, and put it together in a way that applies to your delivery business. Im not a tax expert but I relied a lot on tax experts to put this all together.

Get a tax pro.

And in my opinion, a tax preparer is not a tax pro. Theyre trained to do the software. Dont rely on the sign twirlers and big box store outposts.

Find someone who knows self employment tax inside and out. Theyll pay for themselves.

What To Do If You Have Not Filed Taxes

If you havent already filed your 2020 tax return, you can claim the exemption allowed by the American Rescue Plan when you file.

You can find all the information about what benefits you were paid and how much was withheld using Form 1099-G, which you should have received from your state unemployment office by mail or electronically. You may receive separate forms for state unemployment compensation and any federal benefits you received, but you should report all benefits you were paid on your return, according to the IRS.

If you qualify, youll report your total benefits from Form 1099-G separately from the exclusion. Heres how:

Generally, you report your taxes using Form 1040. But when you claim unemployment insurance, you must also complete a Schedule 1 form to report this additional income. Under the new exemption, you should report the total amount of unemployment compensation you received on line 7 of Schedule 1. Then, use the Unemployment Compensation Exclusion Worksheet to determine the exclusion amount youre eligible for, which youll report on line 8 of Schedule 1.

If you work with a tax preparer to file, they should be able to assist you in working out what to report on these forms using IRS guidance. If you file using a tax software, the IRS says these changes should now be reflected in the software you use to prepare electronically.

How To Prepare For Income Taxes

Knowing that you may have to pay income taxes on your unemployment benefits, you can choose from several options to help make the payments more manageable.

  • Request tax withholdings. When you were working, your company may have withheld money for taxes and made those payments on your behalf. You can also ask your state to do the same with your weekly unemployment benefits. It will withhold 10% of your unemployment pay, which it will send to the IRS. You may also request state or local tax withholdings if they apply to you.
  • Pay estimated taxes. Another option is to make estimated tax payments to the IRS and your state tax agency every quarter. Depending on how much unemployment you collect, and what other sources of income you have throughout the year, you may want to do this even if you have money withheld from your benefits. If you wind up owing more than $1,000 in income taxes, you may have to pay an additional underpayment penalty.
  • Set money aside. You could choose to keep all your unemployment benefits if you donât expect to owe any taxes. Or, even if you expect to owe a little, you could still keep the money and set a portion aside in a savings account in case thereâs an emergency in the interim. An income tax calculator could help you estimate how much youâll want to set aside.

Tax filers will be able to choose whether they want to use either their 2019 or 2020 earned income to calculate the Earned Income Tax Credit on their 2020 income tax returns, thanks to a one-time lookback provision. The lookback will help financially challenged people qualify for the refundable portion of the Child Tax Credit, which is allowed even if you do not owe any tax.

Unemployment compensation is taxable income. Since many did not have taxes withheld, they could face a tax bill. A generous payout for the earned income credit could offset some taxes that will be owed and even contribute to a tax refund.

The earned income credit will vary. The maximum credit is $6,660 for those filing a 2020 tax return but applies only to tax filers who have three or more qualifying children. By contrast, the maximum credit is $538 for someone who has a limited earned income but no children.

The maximum adjusted gross income allowed to obtain the earned income credit is up to $15,820 for those who are single with no children.

The highest cutoff is $56,844 for married couples filing a joint return with three or more qualifying children. The cutoff is an adjusted gross income of $41,756 for those who are single, widowed or head of household with one child.
