    How To File The Missed Returns For Fy 2020

    The amendment made in the Finance Act 2016 stated that income tax returns must be filed within the end of the relevant assessment year, effective from the assessment year 2017-18. There is no provision for you to file the returns once you have missed the due date. The income tax department allows taxpayers to file returns post-deadline in some specific cases. The following ways help you file a condonation of delay request:

  • Request the Income Tax Commissioner or the prescribed authority to permit you to file income tax returns and state the reason for missing the deadline. The officer can accept your request based on the following criteria:
  • The claim is correct and genuine.
  • The case is based on genuine hardship of merits.
  • A refund has resulted due to excess tax deduction, TDS, advance tax, or self-assessment tax.
  • Any other person cannot assess the tax under the Income Tax Act.
  • For such applications, the returns must be filed within a period of six years from the end of the assessment year for filing the return. For example, if you have missed filing returns on the due date of 31 March 2021, you can file such an application until 31 March 2026.
  • If you have not paid the tax for FY 2020-21, you must pay the tax along with applicable interest under Section 234A, 234B, or 234C. You must pay the tax even if you are unable to file your income tax returns.
  • What Tax Documents Do I Need To File Back Taxes

    When was the last year you filed? Do you have a copy of that tax return? Do you still have W-2s and other tax documents for the years you didnt file?

    You can request copies of your tax documents from the IRS if youre missing anything by filing Form 4506-T, or you can contact your employer or the institution that would have sent them to you.

    The CRAs policy is to encourage tax laggards to come clean through tax amnesty. The VDP is designed to encourage both individuals and corporations to come forward and disclose material they didnt previously report, possibly avoiding penalties or prosecution.

    The application must be voluntary, and the CRA must not have initiated an enforcement action, including sending out an audit letter. This criterion makes it harder for those who intentionally avoid paying their taxes to benefit from the program.

    Taxpayers with extraordinary circumstances, like financial hardships, may have further options for relief from their tax obligations.

    Free File Available January 14

    IRS Free File will open January 14 when participating providers will accept completed returns and hold them until they can be filed electronically with the IRS. Many commercial tax preparation software companies and tax professionals will also be accepting and preparing tax returns before January 24 to submit the returns when the IRS systems open.

    The IRS strongly encourages people to file their tax returns electronically to minimize errors and for faster refunds as well having all the information they need to file an accurate return to avoid delays. The IRSs Free File program allows taxpayers who made $73,000 or less in 2021 to file their taxes electronically for free using software provided by commercial tax filing companies.     An Offer In Compromise

    An offer in compromise is a bit more complex. It involves reaching an agreement with the IRS to pay less than your full balance due. An offer in compromise is typically only approved if youre unable to pay through an installment plan and comes with an application fee. Youll probably need the help of a professional for this option.

    You must establish that you cannot pay your balance through an installment agreement or by any other means. All your past due tax returns must be filed before the IRS can grant you this relief, and you must have made some payment toward taxes in the current year, either through withholding from your paychecks or by sending in quarterly estimated payments, even though you havent filed a tax return for the year yet.

    As a result of the COVID-19 pandemic, taxpayers were granted an extension for their 2019 taxes. However, the deadline to file 2020 personal income tax returns remains on course for the end of April:

    The interest rates the CRA charges can change every three months. For now, the CRA charges 5% on overdue taxes down 1% from the year before.

    If you owe taxes and dont file your return by the deadline, the CRA will also charge you a late-filing penalty. The penalty is 5% of your 2020 balance owing, plus 1% of your balance owing for each full month that your return is late, to a maximum of 12 months.

    However, you would also becharged interest compounded daily for overdue taxes and this rate changes every three months.

    If you need more time because you live in an area hit by a natural disaster, you might qualify for tax relief from the IRS. The IRS often postpones the tax filing deadline for taxpayers who live in or have a business within a federally declared disaster area.
