IRS Tax Tip 2018-43, March 21, 2018

As people are filing their taxes, the IRS reminds taxpayers to hang onto their tax records. Generally, the IRS recommends keeping copies of tax returns and supporting documents at least three years. Taxpayers should keep some documents such as those related to real estate sales for three years after filing the return on which they reported the transaction.

Gather Your Tax Files And Double

I received a letter from the IRS

The first step if you have not received your expected refund is to double check your numbers and gather your tax forms. I did my personal taxes myself using TurboTax this year. All of my past taxes are filed away in a secure Dropbox folder, so I am always able to quickly find my 1040 forms going back to my first tax return in the year 2000. I just checked and at the ripe age of 15, I owed $17.

In 2018, my taxes looked a lot different. Based on my inputs, TurboTax said I should get about $3,500 back. If you have not received an expected refund, you’ll need the exact amount to check your status online, so jot that down for the next step.

Can I Call The Irs To Get Answers

While you could try calling the IRS to check your status, the agency’s live phone assistance is extremely limited.

The IRS is directing taxpayers to the Let Us Help You page on its website and to get in-person help at Taxpayer Assistance Centers around the country. You can contact your local IRS office or call to make an appointment: 844-545-5640. You can also contact the Taxpayer Advocate Service if you’re eligible for assistance by calling: 877-777-4778.

Though the chances of getting live assistance are slim, the IRS says you should only call the agency directly if it’s been 21 days or more since you filed your taxes online, or if the Where’s My Refund tool tells you to. You can call 800-829-1040 or 800-829-8374 during regular business hours. If you have not received a refund yet, you shouldn’t file a second tax return.

How Do I Calculate My Tax Return

Your tax return amount is, in general, based on line 24 and line 33 . Subtract line 24 from line 33. If the amount on line 33 is larger than the amount on line 24, thats what you overpaid. In theory, you should get this amount back as a refund. Enter this overpayment on line 34.

If the total tax owed is more than the tax you paid , youll owe taxes. Subtract line 33 from line 24 to find out how much. Put this underpayment amount on line 37. This is the amount you owe.

Put 0 on lines 34 and 35a if the result is exactly zero, although this is rare. It means that your payments met your tax liability dollar for dollar. You have no refund coming and no balance due.

    3.11.23 Excise Tax Returns

It turned out my taxes hit some kind of system error. The first time I called, after the 21-day mark, they said my taxes had an error and the system should resolve the issue itself within the 12-week window after filing.

Once 12 weeks passed, I called again. This time, the gentleman I spoke to said there was a system error that wouldn’t fix itself. He submitted a request to another team to re-process my taxes and said I should get the refund within another eight weeks.

Everyone has a different tax situation. Luckily I wasn’t facing an audit or a penalty. But I did need to call to get my refund resolved. You will probably get different news, but you won’t know until you call to find out.

How To Verify With The Irs That A Tax Return Was Received

Once youve put in the time and effort required to file your tax return, you want to make sure your work isnt lost in cyberspace or in the mail. If youre due a refund, you want your forms to arrive safely and be processed as quickly as possible. The Internal Revenue Service offers several ways for you to verify that your return has been received and that your IRS refund status is being processed.

Why Am I Being Selected For An Audit

Selection for an audit does not always suggest there’s a problem. The IRS uses several different methods:

    • Random selection and computer screening – sometimes returns are selected based solely on a statistical formula. We compare your tax return against “norms” for similar returns. We develop these “norms” from audits of a statistically valid random sample of returns, as part of the National Research Program the IRS conducts. The IRS uses this program to update return selection information.
    • Related examinations we may select your returns when they involve issues or transactions with other taxpayers, such as business partners or investors, whose returns were selected for audit.

Next, an experienced auditor reviews the return. They may accept it or if the auditor notes something questionable, they will identify the items noted and forward the return for assignment to an examination group.

Note: filing an amended return does not affect the selection process of the original return. However, amended returns also go through a screening process and the amended return may be selected for audit. Additionally, a refund is not necessarily a trigger for an audit.

How The Treasury Offset Program Works

Here’s how the Treasury Offset Program works:

  • The TOP will check if your name and taxpayer information are in its delinquent debtor database.
  • If there is a match, TOP will notify you that it is deducting the amount you owe from your tax refund.
  • TOP will send the outstanding amount to the government agency to which you owed the money.
  • If you owe more money than the payment you were going to receive, then TOP will send the entire amount to the other government agency. If you owe less, TOP will send the agency the amount you owed, and then send you the remaining balance.

Here’s an example: you were going to receive a $1,500 federal tax refund. But you are delinquent on a student loan and have $1,000 outstanding. TOP will deduct $1,000 from your tax refund and send it to the correct government agency. It will also send you a notice of its action, along with the remaining $500 that was due to you as a tax refund.

Tax Refunds Depend On Your Withholding

Millions to receive notices from IRS of unpaid taxes

Uncle Sam withholds a portion of every paycheck to cover your tax obligation for the year. In a perfect world, youd know exactly what that obligation was and could withhold accordingly. As a result, youd never be owed a refund or receive a surprise bill after preparing your tax return.

In the real world, however, calculating your tax obligation in advance is difficult because your income might change or you may want to claim certain deductions. Thats why most people either receive a refund or have to pay a bit extra when they file.

Neither is a judgment about your finances. A refund just means you withheld too much from your paycheck, while an addition tax liability means you didnt withhold enough.

How Far Back Can The Irs Go To Audit My Return

Generally, the IRS can include returns filed within the last three years in an audit. If we identify a substantial error, we may add additional years. We usually don’t go back more than the last six years.

The IRS tries to audit tax returns as soon as possible after they are filed. Accordingly most audits will be of returns filed within the last two years.

If an audit is not resolved, we may request extending the statute of limitations for assessment tax. The statute of limitations limits the time allowed to assess additional tax. It is generally three years after a return is due or was filed, whichever is later. There is also a statute of limitations for making refunds. Extending the statute gives you more time to provide further documentation to support your position request an appeal if you do not agree with the audit results or to claim a tax refund or credit. It also gives the IRS time to complete the audit and provides time to process the audit results.

You don’t have to agree to extend the statute of limitations date. However if you don’t agree, the auditor will be forced to make a determination based upon the information provided.

You can find more information about extending a statute of limitations in Publication 1035, Extending the Tax Assessment PeriodPDF, or from your auditor.
