Appealing property taxes in Texas is typically initiated by the individual property owner. In some cases, though, taxpayers may opt to hire a licensed property tax protest consultant to file the appeal, prepare the necessary evidence, and represent them at appraisal district hearings.

Before hiring, be sure to find a company that charges contingency-based fees. Be wary of companies that require you to pay upfront, and look for a consultant that charges only if they successfully win a reduction for the property owner. Choose a company with extensive knowledge of the appeal process, an understanding of appraisal methods, and an awareness of any and all exemptions, such as homestead exemptions, for which a homeowner might qualify.

Diane Flores has lived in her Mesquite home for 26 years. At one point, her taxes were around $2,000 but they’re now around $7,000.

“When I see the property taxes, I just know I’m not going to get scared, I try not to panic because I know Im going to protest, I know Im going to fight this,” said Flores.

She protests every year and always encourages her neighbors to do the same.

“If you protest trust me, you will get some kind of reduction, Ive always been successful,” said Flores based on her experience. “Theres not one year that I can think of that they blew me off and said, No.

While the area around her may be growing, her house hasn’t and from the outside, her bricked two-story home gives one appearance, but on the inside repairs are needed.

“Our properties are being taxed assuming that weve updated all of our homes, assuming that I have a new ceiling that I have granite countertops, that Ive updated my bathrooms and I dont have brass doorknobs throughout the house. All of that needs to be taken into consideration,” said Flores.

She documents every room in detail when she protests, but she said she doesn’t release all of it at the same time.

She said her roof still has popcorn ceilings, there are floors that need to be replaced, windows that are separating from the edge and creating moisture, and a long list of other renovations, that can’t be taken care of all at once.

“You have to prove it you have to show pictures you have to let them know,” said Flores.

Your Home Value Starts Jan 1

Your homes appraised value for the year is based on its condition and what the appraisal district estimates the sale price for your property could be on Jan.1. Any damage or improvements after this date say, a tree that falls on your roof in March, or the new bathroom you added in May wont affect the taxable value of your home this year.

What Should I Do With The Photos Of My House

It is important you bring as many photos of repairs needed and any disrepair of your home as possible, inside and out. Little things and big things, you are not trying to sell your house, you are doing the opposite. You can also include the area and neighbors, construction, industry, or anything that could reduce your homes value. AUSTIN Central Texas homeowners may be seeking property tax relief following sharp increases in home appraisals this year. Travis County appraised market values could rise almost 40 to 50% in some areas, according to the chief appraiser for Travis Central Appraisal District.

If a property owner disagrees with their homes appraised market value or the value that a property would sell for as of Jan. 1, they can submit a protest with their countys appraisal district.

The deadline to submit a protest form is May 16.

Knock Out Their Evidence Against You

The second strategy takes advantage of the confusion and work overload appraisal districts endure, especially if everybody files a protest.

According to the rules of this process, no evidence may be presented at a hearing by either the county appraiser or by you if this evidence isnt shown to the other side.

What kind of evidence? Photos, comparable properties, repair estimates. They are supposed to see what you have, and you should see what they have. They can see yours at a hearing or in the affidavit described above.

Their evidence against you, on the other hand, cant wait for the hearing. The district must produce your evidence before your hearing. It arrives via mail, email or through the districts website.

But they only have to give it to you if you ask for it.

Heres the important part. If they fail to provide the evidence ahead of time, they cant use it at the hearing. And appraisal districts are often not set up to easily distribute the information in a timely way. This is a sensitive pressure point, and you take advantage of it.

As Goodrich explains, I would advise anyone to make the 14-day evidence request almost as soon as you file the protest. That way you can say you gave the appraisal district ample time to fulfill the request.

    Better preparation leads to better results. Make sure you have rational evidence that supports that your assessed value is too high. Such evidence could include:

    • Blueprints, engineering reports, photos, receipts or estimates for repairs, deed records, or sales price documentation
    • Statements from contractors or independent appraisers that support your claim
    • Assessments of properties similar to your property

    How Will I Know If My Appraisal Value Has Increased

    If the appraisal district appraises your property at a higher amount than in the previous year, they are required to send a notice of appraised value by May 1, or by April 1 if your property is a residence homestead, or as soon as practical thereafter.

    The notice of appraised value includes information on how to file a protest.

    The notice will also include information about how to schedule an informal conference with the appraisal district prior to your formal Appraisal Review Board hearing.

    Strategies That Win Property Tax Protests

    If you believe your local appraisal district has over-valued your home, you can challenge that valuation through a property tax protest. You have the right to a hearing in front of the local Appraisal Review Board . During an ARB hearing, you want to present evidence that your tax-assessment value is greater than the market value of your home.

    Before your ARB hearing, you can use the following strategies to collect evidence that shows the appraisal district over-valued your property.

    Meet With Appraisal Review Board

    If you take your case to the appraisal review board, come prepared and expect a rapid-fire proceeding. The entire hearing will likely take 15 to 30 minutes. In that time you will be placed under oath and given a chance to present any evidence or witnesses supporting your case. You must conclude by stating the figure you believe your property is worth. Someone from the appraisal district will likely question you and provide additional evidence. Then you can question the appraiser or any witnesses presented by the appraisal district. Members of the appraisal review board can ask clarifying questions, too. Finally, each side gets to make a closing statement, so once again youll want to reiterate what you believe your property is worth and why. The three-member panel will discuss the case and reach a recommended value.

    The full appraisal review board will review the recommendation of the three-person panel and approve your final assessed value. Youll get a certified letter in the mail with the decision.

    People can apply for a Temporary Exemption for Disaster Damage

    The damage has to be at least 15 percent of the improvement value, to the structure, not the land.

    If you have a $200,000 home for instance and $100,000 is land and $100,000 is improvement, then you would have need to incurred $15,000 dollars worth of damage to qualify, explained Wiggins.

    People have to apply by May 28th and that is through their countys appraisal district.
