Which Benefits Are Taxed

Typically, unemployment insurance benefits are subject to federal income tax. You may have been unemployed, but its still income, and consequently still subject to income tax.

In addition, some states also expect you to pay income tax on unemployment benefits that you receive. Obviously, states without a state income tax, such as Alaska, Nevada, and Washington, dont tax unemployment compensation either. But even some states with a state income tax dont tax unemployment insurance benefits, such as Alabama, California, and the District of Columbia .

Your city or county may tax unemployment compensation as well.

In 2020, 40 million people received unemployment compensation, and fewer than 40% of them had taxes withheld on it, according to USA Today.

If youre one of them, its important to make sure youre keeping track of the amount youre making in unemployment compensation throughout the year so that youll have the money to pay the taxes at the end of the year, or quarterly through estimated taxes. On the federal level, the IRS can help you keep track of that as well.

Reporting Unemployment Benefits At The State And Local Level

If your state, county, or city collects income tax on your unemployment benefits, keep your Form 1099-G for reference. You may have to attach it to your state, county, or local income tax return. If so, keep a copy for yourself.

Check with your states Department of Revenue and relevant county and local government tax agency for instructions on how to report your unemployment benefits at the state and local level.

Income Tax Refund Information

You can check the status of your current year refund online, or by calling the automated line at 260-7701 or 1-800-218-8160. Be sure you have a copy of your return on hand to verify information. You can also e-mail us at to check on your refund. Remember to include your name, Social Security number and refund amount in your e-mail request.

If you’re expecting a tax refund and want it quickly, file electronically – instead of using a paper return.

If you choose direct deposit, we will transfer your refund to your bank account within a few days from the date your return is accepted and processed.

Electronic filers

We usually process electronically filed tax returns the same day that the return is transmitted to us.

If you filed electronically through a professional tax preparer and haven’t received your refund check our online system. If not there, call your preparer to make sure that your return was transmitted to us and on what date. If sufficient time has passed from that date, call our Refund line.

Paper filers

Paper returns take approximately 30 days to process. Keep in mind that acknowledgment of the receipt of your return takes place when your return has processed and appears in our computer system.

Typically, a refund can also be delayed when the return contains:

  • Missing entries in the required sections.
  • An amount claimed for estimated taxes paid that doesn’t correspond with the amount we have on file.

You cannot check it. The IRS has just started to send out those extra refunds and will continue to send them during the next several months.

If you are eligible for the extra refund for federal tax that was withheld from your unemployment the IRS will be sending you an additional refund sometime during the next several months. TurboTax cannot track or predict when it will be sent.

A1. No. The American Rescue Plan Act allows eligible taxpayers to exclude up to $10,200 from their gross income, which will likely lower the tax liability on their 2020 tax return. The exclusion from gross income is not a refundable tax credit. However, the exclusion could result in an overpayment of the tax paid on the amount of excluded unemployment compensation.

What Are The Unemployment Tax Refunds

The American Rescue Plan Act, which was signed on March 11, included a $10,200 tax exemption for 2020 unemployment benefits.

The exemption, which applied to federal taxes, meant that unemployment checks sent during the pandemic werent counted as earned income.

But because the change happened after some people filed their taxes, IRS is issuing refunds for overpayments or it may use it to pay other taxes owed.

Its important to note that the $10,200 figure is the amount taxpayers can exclude from their earnings, not the amount of the refund.

The latter will vary between households, depending on overall income, your tax bracket and how much of your earnings came from the benefits.

Usually, a notice of adjustment is received within 30 days of when the correction is made. Please keep this notice for your records.

IRS sends out another 430,000 refunds for 2020 unemployment benefit overpayments. Since the IRS began issuing refunds for this, it has adjusted the taxes of 11.7 million people, sending out $14.4 billion overall. All totaled, officials say they have identified 16 million people who are eligible for the adjustment.

More About Unemployment Refunds

The IRS has provided some information on its website about taxes and unemployment compensation. But were still unclear on the timeline for payments, which banks get direct deposits first or who to contact at the IRS if theres a problem with your refund.

Some states, but not all, are adopting the unemployment exemption for 2020 state income tax returns. Because some fully tax unemployment benefits and others dont, you might have to do some digging to see if the unemployment tax break will apply to your state income taxes.

About The Unemployment Compensation Exemption

The American Rescue Plan Act, which was enacted in March, exempts up to $10,200 of unemployment benefits received in 2020 from federal income tax for households reporting an adjusted gross income less than $150,000 on their 2020 tax return. If you received more than $10,200 in unemployment compensation last year, any amount over $10,200 is still taxable.

The IRS has identified over 10 million people who filed their tax returns before the plan became law and is reviewing those returns to determine the correct amount of tax on their unemployment compensation. For those affected, this could result in a refund, a reduced tax bill, or no change at all.

The IRS started recalculating impacted tax returns with returns from single taxpayers who had relatively simple returns, such as those filed by people who didn’t claim children as dependents or any refundable tax credits. The tax agency then shifted to joint returns filed by married couples who are eligible for an exemption up to $20,400 and others with more complex returns.

Remember, though, that the tax exemption only applies to unemployment benefits received in 2020. So, if you receive unemployment compensation in 2021 or beyond, expect to pay federal tax on the amount you get.

So Far In The 2022 Tax Season The Average Tax Refund Is More Than $3300

For some Americans, this years tax season was easy. They filed electronically, elected to have their money sent by direct deposit to their bank account and, in three weeks or less, got their refund.

The IRS said that, as of March 18, almost 52 million refunds have been issued worth more than $171 billion, with the average payment totaling $3,305.

If you live in a state that has a state income tax, you may need to pay state income taxes on your unemployment benefits in addition to federal income taxes.

For states that dont have a state income tax or dont consider unemployment benefits taxable income, you wont need to pay state income taxes on your unemployment benefits. These are 17 states that dont tax unemployment benefits:

States that dont have any income taxes Alaska, Florida, Nevada, South Dakota, Texas, Washington, and Wyoming
States that only have income taxes for investment income New Hampshire and Tennessee

You May Now Qualify For Other Tax Breaks

The IRS will automatically adjust your tax return if you qualify for the unemployment tax break, which may affect your eligibility for the Earned Income Tax Credit, Additional Child Tax Credit, American Opportunity Tax Credit, Premium Tax Credit and the Recovery Rebate Credit on your tax return.

If you didnt claim the Earned Income Tax Credit or the Additional Child Tax Credit, but may now be eligible for them, the IRS will send notices by mail requesting additional information to determine if you qualify. Once they receive your response, the IRS will make the necessary adjustments to your tax return, although they havent yet disclosed how theyll send refunds if applicable.

However, if you now qualify for other tax benefits, such asthe tuition and fees deduction and the student loan interest deduction, youll need to file a Form 1040-X, Amended U.S. Individual Income Tax Return to claim them. Use the IRS interactive interviews to determine if you qualify for any additional tax breaks, or speak with a tax professional.

How Do I Determine The Unemployment Refund Amount

Because you didnt know the exact refund amount youre going to receive when the unemployment compensation is factored in your federal income tax return, you have to calculate it yourself. The easiest way to do this is by figuring out your taxable income by not adding the unemployment compensation exclusion youre eligible for and then tax liability. Lastly, compare it with your total tax payments and see how much is your total tax refund. You can then subtract the initial refund you received and find the difference to come up with the unemployment refund. Although this might take some work, take a look at the original copy of your federal income tax return for guidance.

Although this takes some work, it may not be worth it as the majority of the payments have arrived. Give the process a couple of days and youll receive your tax refund direct deposited into your bank account you provided with the IRS.

The IRS hasnt made an announcement on whether or not there will be checks. For the time being, its too early to say, as it only has been a day since the refunds were issued. As soon as the IRS makes a statement about checks, well keep you updated. In the meantime, you can check the refund status online through the Wheres My Refund tool.

One side note to keep in mind is that the refunds are sent automatically to taxpayers that the IRS has their payment information. If you dont have your bank account information with the IRS, youll get a refund check.

Do I Need To File An Amended Return To Claim The Tax Break

Most taxpayers dont need to file an amended return to claim the exemption. If the IRS determines you are owed a refund on the unemployment tax break, it will automatically correct your return and send a refund without any additional action from your end.

The only reason to file an amended return is if the calculations now make you eligible for additional federal credits and deductions not already included on your original tax return, like the Additional Child Tax Credit or the Earned Income Tax Credit. If you think youre now eligible for deductions or credits based on an adjustment, the most recent IRS release has a list of people who should file an amended return.

The average IRS refund for those who paid too much tax on jobless benefits is $1,686.

Information Needed For Your Federal Income Tax Return

Each January, we mail an IRS Form 1099-G to individuals we paid unemployment benefits during the prior calendar year. The 1099-G form provides information you need to report your benefits. Use the information from the form, but do not attach a copy of the 1099-G to your federal income tax return because TWC has already reported the 1099-G information to the IRS. You can file your federal tax return without a 1099-G form, as explained below in Filing Your Return Without Your 1099-G.

A 1099-G form is a federal tax form that lists the total amount of benefits TWC paid you, including:

  • Unemployment benefits
  • Federal income tax withheld from unemployment benefits, if any
  • Alternative Trade Adjustment Assistance and Reemployment Trade Adjustment Assistance payments

After more than three months since the IRS last sent adjustments on 2020 tax returns, the agency finally issued 430,000 refunds on Monday to those who qualify for the unemployment tax break. In total, over 11.7 million refunds have been issued, totaling $14.4 billion. The IRS says it plans to issue another batch by the end of the year.

If you’re entitled to a refund, the IRS will directly deposit it into your bank account if you provided the necessary bank account information on your 2020 tax return. If valid bank account information is not available, the IRS will mail a paper check to your address of record. The IRS says it will continue to send refunds until all identified tax returns have been reviewed and adjusted.

The IRS will send you a notice explaining any corrections. Expect the notice within 30 days of when the correction is made. Keep any notices you receive for your records, and make sure you review your return after receiving an IRS notice.

The refunds are also subject to normal offset rules. So, the amount you get could be reduced if you owe federal tax, state income tax, state unemployment compensation debt, child support, spousal support, or certain federal non-tax debt . The IRS will send a separate notice to you if your refund is offset to pay any unpaid debts.

Refund checks are mailed to your last known address. If you move without notifying the IRS or the U.S. Postal Service , your refund check may be returned to the IRS.
