California Sales Tax: Where Does The Money Go

As mentioned above, the California sales tax is 7.25%. All cities must collect at least this much in sales tax. Only 6% actually goes to the state though. The remaining 1.25% goes toward county funds. Lets take a look at where that money is going.

The states 6% goes to a few different places. The majority of that money, 3.9375%, goes to the general fund that Californias government uses to finance itself. Another 1.0625% goes toward a Local Revenue Fund that the state established in 2011. The money in this fund pays for public safety programs and services. The remaining state sales tax revenue is split between two funds. A Local Public Safety Fund gets 0.5% to support local criminal justice activities. A Local Revenue Fund, which supports health and social service programs, gets the final 0.5%.

The remaining 1.25% of the California sales tax is a county tax. The entire state must pay this tax and the money all goes to county and/or city governments. The 1.25% breaks down into two different funds. County or city operational funds gets 1%. The last 0.25% goes toward county transportation funds.

Why Was The Californiaexit Tax Of 2020 Created

The exit tax is intended to recoup some of the money that California has invested in these businesses and individuals.

For example, if a business owner has received tax breaks or other financial incentives from the state, the exit tax ensures that they will still contribute some money to California’s economy even after they leave.

The primary reason for the enactment of the exit tax was to close a loophole that allowed people to avoid paying taxes on their capital gains.

Under federal law, capital gains are only taxed when they are realized. This means that if someone buys a stock for $1,000 and it goes up to $10,000, they don’t have to pay taxes on that $9,000 until they sell the stock.

If that person lived in California and then moved to another state before selling the stock, they would never have to pay taxes on that $9,000 in capital gains.

To close this loophole, the Golden State enacted the California wealth and exit tax. Now, anyone who leaves the state is required to pay taxes on their unrealized capital gains.

Its been criticized by many people, who argue that it is unfair and punitive. They point out that many people who are leaving California are doing so because they can no longer afford to live there.

What’s more, they argue that the exit tax will make it even harder for these businesses and individuals to get back on their feet financially once they’re in their new location.

When Are Services Subject To California Sales Tax

California law restricts the application of sales or use tax to transfers or consumption of tangible personal property or physical property other than real estate. Unlike many other states, California does not tax services unless they are an integral part of a taxable transfer of property. The law does not specifically name most services as exempt, but such activities are automatically excluded from the tax base because they are outside the definition of tangible personal property.

Two types of service activities still may be swept into the tax base, however. The first is any service that is so tied to the sale of property that it is considered a part of that sale and, thus, inseparable from the measure of the tax. Example: a taxable sale of machinery that the seller must calibrate as a condition of the sale. The calibration fee will be taxable even if the seller separates the charge.

The second taxable service is fabrication. Fabrication is the labor involved in creating tangible personal property that is different in form or function from its component parts. This type of labor includes something as simple as drilling holes in a metal strap and bending the strap to make a bracket. The charge for drilling and bending would be taxable unless some other exemption applied.

Sales and use tax law is often assumed to be relatively simple and straightforward.

As you can see, that assumption may be hazardous to your financial health.

Certain Kinds Of Food Taxation

As you may have guessed, the top necessity of life is food. However, the exemptions can appear complicated because the CDTFA looks at a variety of items that may not seem to be food but are related in a way that allows tax exemption.

For example, most food products for human consumption are easily recognized but where and how they are sold impacts the exemption. Food that falls under the following conditions is considered taxable:

  • Sold in a heated condition
  • Served as meals
  • Consumed on or at a sellers facilities
  • Is ordinarily sold for consumption on or near the sellers parking facility, or

However, there is an exception. Hot bakery items or hot beverages such as coffee sold for a separate price are still tax exempt.

The justification for the tax exemption on food products sold through a vending machine is just as convoluted. The vending machine operator is considered the consumer of any food products retailing for 15 cents or less and food products sold through bulk vending machines for 25 cents or less.

Wait, there is more: for sales of cold food products, hot coffee, hot tea and hot chocolate through a vending machine for more than 15 cents, 67 percent of the receipts are tax exempt. The rest is fully taxed.

Other necessities of life include health-related products, services, and meals as well as some utilities like gas, water and electricity.

How Much Are Sales Taxes In California

There are seven components to the sales and use tax rate six are state and one is local. Just over half of the sales and use tax goes to the states General Fund.

A portion of a percent is sent to the state for local safety, statewide education, and local revenue support for health and social services.

The local component receives just over 1 percent for county transportation and city or county operations.

So, in San Diego for example, the sales tax rate is 8.25 percent. However, the City of Poway charges 7.75 percent. So, taking the base rate of 7.25 percent, San Diego adds another 1.0 percent for district taxes and Poway adds .50 percent.

Local transaction and use taxes, known as sales taxes, are used by local governments to increase revenue and are always in addition to the state-imposed sales tax rate of 7.25 percent.
