How Your Home Of Record Affects Your State Tax Return

If you are serving on active duty in the military, you just need to file one state tax return for your Home of Record or state of legal residence unless you have state specific income, such as business income, civilian wages, or rental income, in addition to your military income. This applies regardless if you are stationed in another US state, territory, or overseas. This makes it easier for military members, who may move multiple times during a year, so they only have to file one state tax return for their SLR.

Only filing state taxes in for your SLR provides a huge benefit to military members, whos state either does not have a state income tax or does not tax military income. Ohio does not tax military income, if you are stationed outside of Ohio. If your Home of Record / state of legal residence is in a different state, you can check here to determine how your state taxes military income.

Example. Johns enlisted in the military when he was living in North Carolina. Two years ago, he was stationed in Ohio and updated his state of legal residence to Ohio, which was accepted. Last year, John was stationed in Virginia for the entire year and earned the following income:

$25,000 Military Income

$10,000 Business Income from the Family Business in North Carolina

$12,000 Rental Income from His Rental Property in Virginia and

$10,000 Part-time Job in Virginia.

$15,000 Military Income while Stationed in North Carolina and

    What Does State Tax Reciprocity Mean

    To put it simply, if the state where you work has a reciprocal tax agreement with the state where you live, then your work state shouldnt withhold taxes from your paycheck. This makes filing state taxes simpler because you wont be required to file a return for both states, and you wont be waiting for your work state to send a refund if youre owed one.

    Tax reciprocity only applies to state and local taxes. Youll still be required to pay federal income taxes no matter where you live/work.

    Individual Income Tax Filing Due Dates

    • Per the Virginia Tax website: Typically, most people must file their tax return by May 1. However, the filing deadline for 2020 individual income tax returns has been extended to Monday, May 17, 2021.     • Fiscal year filers: Returns are due the 15th day of the 4th month after the close of your fiscal year.

If you have already completed the federal form online, it should be pretty easy to fill out the state return. You can get the forms from your local library or you can print them off at your states Department of Revenue website.

    Calculating Your Amount Due

    You can reduce your state tax liability by any state tax credits that you qualify for. State credits can vary widely, but many states have their own versions of child tax credits and earned income credits.

    Most tax credits can only reduce your tax liability to zero. They’re treated as payment toward any tax you owe.

    Some credits are refundable. Any leftover credit after eliminating your tax debt would be sent to you as a tax refund.

    Montana

    Montana has a reciprocity agreement with North Dakota. If you are a resident of North Dakota but you work in Montana, income should not be withheld from your paycheck for Montana state taxes.

    North Dakota

    North Dakota has a reciprocity agreement with Minnesota and Montana. If you are a resident of Minnesota or Montana but you work in North Dakota, income should not be withheld from your paycheck for North Dakota state taxes.

    Minnesota has a reciprocity agreement with Michigan and North Dakota. If you are a resident of Michigan or North Dakota but you work in Minnesota, income should not be withheld from your paycheck for Minnesota state taxes.

    Iowa has a reciprocity agreement with Illinois. If you are a resident of Illinois but you work in Iowa, income should not be withheld from your paycheck for Iowa state taxes.

    Illinois has a reciprocity agreement with Iowa, Kentucky, Michigan, and Wisconsin. If you are a resident of IA, KY, MI, or WI, but you work in Illinois, income should not be withheld from your paycheck for Illinois state taxes.

    Filing state taxes when you are serving in the military can be complicated and confusing. If you are on active duty and stationed in another state or overseas, you should have state taxes taken out of your pay for your Home of Record or state of legal residence , if it taxes military income. Most states do not. The Home of Record is the state, where the service member enlisted. The HOR and SLR is the same for most military members unless they changed their state of legal residence after enlisting.

    If your spouse is living and working in a state where you are stationed in the military for active duty, state taxes can get more difficult to understand. Even though the current and past administrations have tried to make it easier to file state income tax returns for military families, it still can be difficult to navigate the many state tax laws. Under Obama, the Military Spouse Residency Relief Act was enacted to allow certain military spouses to claim the military members Home of Record or state of legal residence. Under Trump, the Veterans Benefits and Transition Act extended MSRRA to apply to all military spouses regardless if they had established legal state residence in their military spouses state of legal residence or not.

    Are You Required To File State Taxes If You Dont Live There

    If you lived in a state for an entire year, theres no question about your residency status. But what if you moved during the year? Or, what if you were not a resident at all and you just have wage or other income from the state? Lets go over a few scenarios when you have to file state taxes, possibly in more than one state.

    • Moving from state to state If you moved from one state to another during a tax year, you may have to file state taxes in both states. Some states base the filing requirement on a minimum number of days or months you spend in the state.     If youre younger than 70 on or before Dec. 31 of the tax year, you can deduct the amount you contributed to one or more Virginia529 accounts, up to $4,000 per account.
