How Your Home Of Record Affects Your State Tax Return

Virginia – State Withholding Tax Setup

If you are serving on active duty in the military, you just need to file one state tax return for your Home of Record or state of legal residence unless you have state specific income, such as business income, civilian wages, or rental income, in addition to your military income. This applies regardless if you are stationed in another US state, territory, or overseas. This makes it easier for military members, who may move multiple times during a year, so they only have to file one state tax return for their SLR.

Only filing state taxes in for your SLR provides a huge benefit to military members, whos state either does not have a state income tax or does not tax military income. Ohio does not tax military income, if you are stationed outside of Ohio. If your Home of Record / state of legal residence is in a different state, you can check here to determine how your state taxes military income.

Example. Johns enlisted in the military when he was living in North Carolina. Two years ago, he was stationed in Ohio and updated his state of legal residence to Ohio, which was accepted. Last year, John was stationed in Virginia for the entire year and earned the following income:

$25,000 Military Income

$10,000 Business Income from the Family Business in North Carolina

$12,000 Rental Income from His Rental Property in Virginia and

$10,000 Part-time Job in Virginia.

$15,000 Military Income while Stationed in North Carolina and

$10,000 Military Income while Stationed in Texas.

    Calculating Your Amount Due

You can reduce your state tax liability by any state tax credits that you qualify for. State credits can vary widely, but many states have their own versions of child tax credits and earned income credits.

Most tax credits can only reduce your tax liability to zero. They’re treated as payment toward any tax you owe.

Some credits are refundable. Any leftover credit after eliminating your tax debt would be sent to you as a tax refund.

Filing State Taxes When You Are Serving In The Military

Filing state taxes when you are serving in the military can be complicated and confusing. If you are on active duty and stationed in another state or overseas, you should have state taxes taken out of your pay for your Home of Record or state of legal residence , if it taxes military income. Most states do not. The Home of Record is the state, where the service member enlisted. The HOR and SLR is the same for most military members unless they changed their state of legal residence after enlisting.

If your spouse is living and working in a state where you are stationed in the military for active duty, state taxes can get more difficult to understand. Even though the current and past administrations have tried to make it easier to file state income tax returns for military families, it still can be difficult to navigate the many state tax laws. Under Obama, the Military Spouse Residency Relief Act was enacted to allow certain military spouses to claim the military members Home of Record or state of legal residence. Under Trump, the Veterans Benefits and Transition Act extended MSRRA to apply to all military spouses regardless if they had established legal state residence in their military spouses state of legal residence or not.

Are You Required To File State Taxes If You Dont Live There

If you lived in a state for an entire year, theres no question about your residency status. But what if you moved during the year? Or, what if you were not a resident at all and you just have wage or other income from the state? Lets go over a few scenarios when you have to file state taxes, possibly in more than one state.

    • Moving from state to state If you moved from one state to another during a tax year, you may have to file state taxes in both states. Some states base the filing requirement on a minimum number of days or months you spend in the state. In other states, moving there with the intent to stay permanently is enough to require that you file a state return, even if only for a few days. For example, you might wonder if you have to file state taxes in California if you only moved there permanently in late December. In this case, youd be considered a resident and youd need to file a return.

Note: These types of income are also sourced to your resident state regardless of where its earned. However, your resident state will generally allow a credit against state income tax for the income taxes paid to another state on the same income.

Soaccording to the VA Department of Revenue, you will have a VA nonresidentfiling requirement if your income is

    • Single, and Virginia adjusted gross income is $11,950 or more

Virginia adjusted gross income is your federaladjusted gross income plus any Virginiaadditions, minus the Age Deduction and any Virginia subtractions. Virginiaadjusted gross income does not include standard or itemized deductions, thechild and dependent care expense deduction, personal exemptions or otherdeductions from income.

Nonresidents with income from Virginia sourcesare subject to the same filing requirements as residents. This means that thefiling threshold for a nonresident is determined by Virginia adjusted grossincome computed as a resident, including income from all sources. The filingthreshold for a nonresident cannot be based solely on income from Virginiasources.

The IRS has issued a warning regarding unethical tax return preparers, also know as ghost preparers. These ghost preparers prepare and print the return, but then tell the taxpayer to sign and mail it to the IRS. They will not complete the section that requires paid preparers to sign the return and include their 2019 Preparer Tax Identification Number . Paid tax preparers are required to have a valid PTIN. These ghost preparers are scammers seeking to make money quickly, and may hurt taxpayers simply looking to file an accurate tax return. Ghost preparers may:

    • Promise a big refund
    • Charge fees based on a percentage of the refund
    • Require cash payments
    • Erroneously qualify clients for tax credits by inventing income
    • Boost refunds by claiming fake deductions
    • Use their own bank account for direct deposit refunds instead of the taxpayers account

Whether you have to file state taxes depends on a few factors. In some cases, you may not be required to file state taxes if you only lived in the state a short time or if your income is below a certain level. Each state has its own rules, so its good to review the details for where you live and work.

Adjusting Your Federal To State Income

Begin making adjustments after you’ve entered the information from your federal return onto your state income tax return. You must reconcile the differences between your federal taxable income and your state taxable income.

Some of these adjustments will be additions. They’re usually add-backs of any federal tax deductions that you might have taken that aren’t allowed on your state return.

They might also be income items that are tax-exempt for federal purposes but are taxed at the state level.

Other adjustments will be subtractions. These are usually income items that are taxable under federal tax law but are tax-exempt under state tax law. Some of these subtractions can also be state-specific deductions.

The number of adjustments you’ll make on your state tax return will depend on the extent to which your state conforms to and follows the federal tax code.
