How to Get Your Tax-Exempt Status Back

If you receive OAS payments, including the Guaranteed Income Supplement , the amounts you receive are not eligible for the tax exemption under section 87 of the Indian Act. Since OAS and GIS payments are not related to any previous employment and are not considered to have any connection to a reserve, the payments are considered to be off-reserve. The fact that you live on a reserve is not significant enough to connect the income to a reserve. Therefore, normal rules apply to these payments.

Additional Exemption Categories And Requirements

Tax Code Sec. 171.059

A nonprofit corporation organized to provide places of burial is exempt from the franchise tax.

To apply for exemption, complete AP-204. We will review the corporation’s formation documents on file with the Texas Secretary of State to verify that the corporation’s purpose is consistent with the requirements of this section. If the documents do not clearly state the corporation is providing burial sites, a signed statement to that effect should be included. Non-Texas corporations must also include a copy of the corporation’s formation documents and a current Certificate of Existence issued by their state of incorporation.

Tax Code Sec. 171.052

An insurance organization, title insurance company, or title insurance agent authorized to engage in insurance business in Texas now required to pay an annual tax under Chapter 4 or 9, Insurance Code, measured by its gross premium receipts, is exempt from franchise tax. In addition, a non-admitted insurance organization that pays premium receipts tax during a tax year is exempted from the franchise tax for that same tax year. To apply for exemption, complete AP-204. Include copies of any previous and current licenses issued by the Texas Department of Insurance. Non-Texas corporations must also include a copy of the corporation’s formation documents and a current Certificate of Existence issued by their state of incorporation.

Rental Income And Other Income From Property

If you earn income on a reserve from your reserve property, your income will be exempt under section 87 of the Indian Act. For example, if you rent out a home located on a reserve, your rental income will be exempt from tax. Generally, your income from rental property will not be taxed if the physical location of the property is on a reserve.

If you own moveable property that you store on a reserve and you rent it to someone off the reserve for use off the reserve, your rental income will be considered to be off-reserve and will be taxable. Generally, we only consider rental income to be exempt when it comes from renting out rights to occupy or use real property located on a reserve. In any other case, we would have to review all of the connecting factors.

Form 102: The Long Form Application

Now let’s take a look at Form 1023, Application for Recognition of Exemption Under Section 501 of the Internal Revenue Code. Form 1023 is divided into 11 parts, and is covered in more detail below.

Identification of Applicant

This section tells the IRS about your organization. It asks for basic information like the name of your nonprofit corporation, contact information, and when you filed your articles of incorporation.

Your nonprofit must have a federal employer identification number prior to applying for 501 tax exemption, even if it doesn’t have employees. This can be done quickly and easily. Even if your organization held an EIN prior to incorporation, you must obtain a new one for the nonprofit corporate entity. Organizational Structure

This section requires that you attach a copy of your articles of incorporation and your bylaws to the application form. Most nonprofits seeking 501 status are corporations. If your entity is an LLC, unincorporated association, or nonprofit trust, you should seek the help of a lawyer with experience in nonprofit tax law to complete your Form 1023 application.

    How Does An Organization Become Tax

    To be recognized as exempt from federal income taxation, most organizations are required to apply for recognition of exemption. For section 501 organizations, the law provides only limited exceptions to this requirement.     What Is A Public Benefit Organisation

    The conditions and requirements for an organisation to be approved as a PBO are contained in section 30 while the rules governing the preferential tax treatment of PBOs are contained in section 10. Section 10 provides for the exemption from normal tax of certain receipts and accruals of approved PBOs. Certain receipts and accruals from trading or business activities will nevertheless be taxable. ; Approved PBOs have the privilege and responsibility of spending public funds, which they derive from donations or grants, in the public interest on a tax-free basis. The donations or grants may be received from the general public or directly or indirectly from the State. It is therefore important to ensure that exempt organisations use their funds responsibly and solely for their stated objectives, without any personal gain being enjoyed by any person including the founders and the fiduciaries.;; ; Approved PBOs must continue to comply with the Act and related legislation throughout;their existence. This includes the submission of annual income tax returns on an IT12EI Return of Income Exempt Organisations External Form. The income tax return enables the Commissioner to assess whether the;approved;PBO is operating within the prescribed limits of the relevant approval granted and to determine whether the partial taxation principles must be applied to receipts and accruals derived from a trading activity or business undertaking which does not qualify for exemption.

    Business Income Example 3

    Peter operates a trucking business that hauls logs from cutting sites located off-reserve to logging mills located off-reserve.; His only customer is a logging company that is not located on a reserve. Peter has a garage on a reserve where he stores his trucks and an on-reserve office where he keeps the books and records for the business.; Peter travels 20 kms from his off-reserve home each day to pick up his truck from the on-reserve garage. He then travels to the off-reserve cutting sites. Peter spends a few hours each week doing the bookkeeping for the business at the on-reserve office.

    Peters self-employed income is considered to be taxable. The following factors are the most significant and connect the income off-reserve:

    • The income-generating activities of hauling lumber occurs off-reserve.
    • The business only customer is located off-reserve.
    • Most of the business decisions are made off-reserve.
    • Peter does not live on-reserve.

    The on-reserve activities are limited to providing a place to park the trucks when not in use and maintain the books and records. These factors are not significant enough to connect the business income to a reserve.

    Interest And Investment Income

    Throughout the following text, for purposes of the tax exemption under section 87 of the Indian Act, the CRA uses the term Indian because it has a legal meaning in the Indian Act.

    If your investment income is situated on a reserve, it is exempt from tax under section 87 of the Indian Act. The courts have established that determining whether income is situated on a reserve, and thus exempt from tax, requires identifying the various factors connecting the income to a reserve and weighing the significance of each factor. This is referred to as the connecting factors test.

    On July;22, 2011, the Supreme Court of Canada released its decisions in the cases of Estate of Rolland Bastien v. Her Majesty the Queen and Alexandre Dubé v. Her Majesty the Queen . In both cases, the SCC found that the interest income was situated on a reserve and exempt from tax.

    The CRA will apply these decisions in similar situations to exempt an Indian’s interest income from tax for the 2011 and following tax years.

    A similar situation means that all of the following conditions are met:

  • you earn interest income from a savings or chequing account, or from a term deposit or guaranteed investment certificate ;
  • you opened the savings or chequing account, or entered into a contract for a term deposit or GIC, with a financial institution located on a reserve;
  • the financial institution is required to pay the interest income to you at a location of the financial institution on a reserve; and

    Obtaining A 501 Exemption

    A 501 is an Internal Revenue Service exemption, if you have not received an exemption letter from the IRS, you can obtain Form 1023, Application for Recognition of Exemption, by visiting their web site at or call 829-5500. Obtaining a 501 does not guarantee that the organization is exempt for Missouri sales tax purposes, but it does assist the Department in making a determination that the organization qualifies under Missouri statute.

    Irs Approval Time For Nonprofit Tax Exempt Status

    When you file for nonprofit tax-exempt status, under Section 501 of the internal revenue code or elsewhere, it’s natural to be impatient about receiving recognition of exemption for your federal tax and state taxes.

    It may take some time to get a response from the IRS even if you submit all the required forms. According to 501C3.org, it may take anywhere from two months to a year toget a response from the IRS. If you leave out necessary information or the IRS has questions, it can take even longer.

    What If Purposes Or Programs Change After An Application Is Submitted

    If the organization’s organizing documents, purposes, or programs change while the IRS is considering an application, you should report the change in writing to the office processing your application. If you do not know the office that is processing your exemption application, contact Exempt Organizations Customer Account Services.

    Excise Duties And Taxes

    Excise duties and taxes apply to certain products. The manufacturer or distributor, not the consumer, pays these taxes. The CRA administers the legislation which regulates the products to which these taxes apply. The CRA also licenses the manufacturers of these products. Although an amount equal to the tax may be included in the price, the courts have confirmed that Indian individuals are not exempt from such an indirect tax.

    Federal excise duty applies to alcohol and tobacco products. The Excise Act, 2001 is the legislation that imposes excise duty on spirits, wine and tobacco products while the Excise Act governs beer.     The Excise Tax Act imposes federal excise tax on motive fuel products, automotive air conditioners and certain fuel-inefficient vehicles and insurance premiums.     The steps for applying for federal tax-exempt status are quite similar to applying for nonprofit status. There are, however, some important differences.
