Oklahoma Extends State Income Tax Deadline Until June 15

OKLAHOMA CITY Following the IRS lead, the state Tax Commission has extended the deadline for Oklahomans to pay their state income taxes without penalty by two months.

The IRS granted federal income tax extensions to Texas, Oklahoma and Louisiana filers following the Februarys historic winter storm, which dumped snow and caused arctic temperatures and rolling power outages across much of the region.

Oklahoma officials said they opted to follow suit earlier this month to help Oklahomans who typically file their federal and state income taxes together.

Clark Jolley, a state tax commissioner, in a video post, said Oklahomas state statutes are very tricky in the way theyre written. Tax commissioners cannot legally change the April 15 date for filing unless its nationally changed in the United States code, he said.

Getting highly technical, we cant technically move it, but we can effectually move it and effectively weve moved it to June 15 by saying were going to waive any and all penalties and interest, he said. So if you do file after April 15, youre not going to be penalized. Youre not going to pay any penalties or interest.

He said the states June 15 extension applies to personal 2020 income tax returns, franchise tax returns and 2021 income tax estimates.

Even working under a tight calendar, farmers and ranchers are used to making quick financial decisions when conditions are right. Plant between thunderstorms? Take advantage of an equipment sale?

When the federal and state governments recently announced tax deadlines were pushed back, producers were presented with a similar question: File now or later? Does a typically dark cloud actually have a silver lining this time?

Oklahomans usually scramble to get their taxes filed by the April 15 deadline. However, the IRS deadline for 2020 tax returns has been extended to May 17.

The Oklahoma Tax Commission issued a statement adjusting the states deadlines explaining that Oklahomans now have until June 15 to pay their 2020 individual and business income taxes the same is true of first quarter 2021 estimated income tax payments. Shortly after the OTC statement, the Internal Revenue Service posted its own extension. The IRS said individual taxpayers can also postpone their federal income tax payments for the 2020 tax year normally due on April 15 to May 17 instead.

For many qualified Oklahoma farmers, the deadline shuffle is a moot issue, said J.C. Hobbs, Oklahoma State University OSU Extension associate specialist and coordinator of OSU Tax School. By filing before March 1, those producers dont have to pay estimated taxes for the year, a significant benefit that many have already taken advantage of, Hobbs said.

Differences Between The Old And New Taxes

The new Oklahoma franchise tax, which was instituted in 2014, is very similar to the old pre-moratorium franchise tax. For example, both the old and new franchise tax included a maximum annual payment of $200,000.

Because the two taxes were so similar, business entities formed before the moratorium was put in place will likely understand how to correctly file the new tax. On the other hand, businesses formed after the moratorium may have been taken by surprise by the reinstatement of the franchise tax and should be very careful about filing and paying this tax.

Interest on any outstanding balance will be charged from the original due date of the return no matter what.

We recommend filing both federal and state returns at the same time if possible. State returns typically “piggyback” off the federal return, so it’s usually easier to do them at the same time. There’s also a better chance of avoiding discrepancies if you do them together. However, if that’s not possible, having an extra week to file your Oklahoma return can help. It gives you more time to focus on getting your federal return off before the April 15 deadline and then to get your state return just right.
