Municipal Utility District tax notices are mailed in October. Taxes are due upon receipt of the statement. Penalty and interest begin to accrue on February 1. Payments are posted according to postmark, so if a payment is mailed in late January, be sure to have the envelope postmarked by the postal service no later than January 31 to avoid penalties and interest.

What Legal Notices Are Associated With A Mud

While you may know that the property is in a MUD, it’s also important to know which notice to send to the contracting party. The notice you use can differ based on where the MUD is located within Austin. These are the notices you’ll need to keep in mind when dealing with MUDs along with when you’ll need to use them:

  • If the MUD is located within the Austin city limits: use notice 49.452 of the Water Code.

  • If the MUD is not in the Austin city limits but within the extraterritorial jurisdiction of the city: use notice 49.452 of the Water Code.

  • If the MUD isn’t in either of these categories: use notice 49.452 of the Water Code.

To obtain these forms, you can either contact the Municipal Utilities District itself and pay a small administrative fee of $10, or get in touch with the county property records office. Both of these offices should be in possession of the appropriate notices you’ll need to send buyers.

Harris County Municipal Utility District No 502

The HARRIS COUNTY M.U.D. #502 will hold a public hearing on a proposed tax rate for the tax year 2021 on October 6, 2021 at 11:00 a.m. at 9955 Barker Cypress Road, Suite 250, Cypress, TX 77433. Your individual taxes may increase at a greater or lesser rate, or even decrease, depending on the tax rate that is adopted and on the change in the taxable value of your property in relation to the change in taxable value of all other property. MUD. It’s a strange acronym that you should be aware of as a real estate agent in Austin. A Municipal Utilities District, also known as MUD, is essentially a special political subdivision that functions as an independent and limited government.

How Is A Mud Created

A majority of property owners in the proposed district petitions the Texas Commission of Environmental Quality to create a MUD. The TCEQ evaluates the petition, holds a public hearing, and grants or denies the petition. After approval, the TCEQ appoints five temporary members to the MUD’s Board of Directors, until an election is called to elect permanent Board members, to confirm the MUD’s creation, and to authorize bonds and taxing authority for bond repayment.

Everyone is likely familiar with PUDs , so let’s focus on the other two: PIDs and MUDs.

What are PIDs and MUDs?

They are both mechanisms developers use to raise funds for utilities and/or amenities needed in a new community. The decision whether or not to use a PID or a MUD to fund development can have long-term implications for buyers and sellers, agents and lenders, and impact the marketability of a neighborhood. Having a basic understanding of the two financing mechanisms is important to help clients make educated decisions and avoid surprises.

A MUD is a Municipal Utility District or an officially classified political subdivision of the State of Texas

MUDs are created under the authority of the Texas Commission of Environmental Quality and provide water, sewage, drainage or other utility-related services to new developments. MUDs are likely to exist in large master planned developments that, when started, fell outside city limits or outside the area where a city was providing utility services. A few recent North Texas developments that are classified as MUDs are Light Farms in Celina, Artesia in Prosper, and Trinity Falls in McKinney.

Note For Harris County Residents

Property in the Harris County portion of the City of Friendswood is assessed by the Harris County Appraisal District. All exemptions must be applied for at the appropriate county appraisal district. Please be assured that although you will receive a tax statement from Galveston County, it is only because they collect the City of Friendswood property taxes.

Paying Taxes With A Mortgage

Lenders often roll property taxes into borrowers monthly mortgage bills. While private lenders who offer conventional loans are usually not required to do that, the FHA requires all of its borrowers to pay taxes along with their monthly mortgage payments.

To determine how much property tax you pay each month, lenders calculate your annual property tax burden and divide that amount by 12. Since their numbers are estimates, some lenders require their borrowers to pay extra money each month in case the property tax payments come up short. If you end up paying more property taxes than you need to, youll receive a refund. If you underpay your property taxes, youll have to make an additional payment.

When you pay property taxes along with your mortgage payment, your lender deposits your property tax payment into an escrow account. When your property taxes are due to the county, your lender uses the funds in that escrow account to pay the taxes on your behalf.

Both you and your lender should receive a notice from your local tax authority. If you dont, its best to contact your lender and your tax authority to make sure your property taxes are being paid on time.

What’s a MUD?

If you’re thinking about buying property in Texas, particularly in the greater Houston area and other large metropolitan areas, sooner or later you’ll hear the word MUD. A MUD is a special governmental entity created by the State of Texas whose main functions are to provide water and wastewater services and to maintain drainage facilities within its boundaries. A MUD may levy and collect taxes, issue bonds, charge for services, condemn property, enforce restrictive covenants and make regulations to accomplish its purposes. MUDs come in a variety of names – MUD, WCID , WSD , PUD , etc. The list of acronyms is almost endless!

MUDs were created to allow unincorporated areas the financial and legal wherewithal to provide services to commercial and residential customers when comparable services are not readily available through municipal providers like the City of Houston. In the greater Houston area, there are more than 600 MUDs, most of which provide services to one or two subdivisions/residential developments and the commercial properties immediately surrounding those developments.

As a Texas real-estate owner, your local MUD will affect your life in two ways – first, you’ll get a bill from your MUD each month for your water and wastewater treatment services and drainage control services and second, you’ll receive a property tax bill from your MUD each year to pay for its bonded indebtedness and general maintenance and operating expenses.

What Happens When You Pay Off Your Mortgage

Once your mortgage is paid off, your lender wont be collecting payments from you anymore. At that point, paying property taxes becomes your responsibility.

Sometimes lenders let their borrowers start paying their taxes directly before their mortgages are paid off. This might happen if youve paid down a significant portion of your principal loan balance.

Understanding Property Tax Exemptions

Others will actually set tax ceilings that will cap out the amount of taxes you must pay on your residence. The cap is set in the tax year in which you qualify for your exemption and is good for as long as you own the home or until you make improvements to the home that increases the value. At that point, your tax ceiling may need to be adjusted accordingly.

Do Exemptions affect all taxing authorities? The Homestead Exemption does not. It does not affect the MUD District taxes. Even after the Homestead Exemption is filed, MUD taxes are assessed and paid at the full amount.

Other exemptions: Over 65 and Disabled Exemptions can affect all taxing authorities, although it is always best to verify with the individual tax offices once the exemptions are filed.

What if the annual filing deadline is missed? Up to one year from the deadline is given to file. With the Homestead Exemptions, for example, after that, you can lose the benefit for previous years. For Surviving Spouse, it can be more serious. If you fail to file within 12 months, you can lose the exemptions altogether and may be subject to rollback taxes.

Homestead Exemption. This is the most common of the tax exemptions that we see. It may be applied for on a principal residence only.

Qualification requirements:

  • The homeowner must be an individual
  • The home must be used as their principal residence on January 1 of the tax year
  • The owner must file between January 1 and April 30 of the tax year
