So why hasn’t return-free filing happened yet? The short answer is lobbying, and in particular lobbying by companies like Intuit. In 2013, ProPublica’s Liz Day wrote an incredible exposé on just how hard Intuit has lobbied to stop return-free filing from becoming a reality:

a bill to limit return-free filing was introduced by a pair of unlikely allies: Reps. Eric Cantor, R-Va., the conservative House majority leader, and Zoe Lofgren, D-Calif., a liberal stalwart whose district includes Silicon Valley.

Intuit’s political committee and employees have contributed to both. Cantor and his leadership PAC have received $26,100 in the past five years from the company’s PAC and employees. In the last two years, the Intuit PAC and employees donated $26,000 to Lofgren.

â¦In 2005, California launched a pilot program called ReadyReturn. As it fought against the program over the next five years, Intuit spent more than $3 million on overall lobbying and political campaigns in the state, according to Dennis J. Ventry Jr., a professor at UC Davis School of Law who specializes in tax policy and legal ethics.

    So what’s a regular person hoping for return-free filing to do? Well, you could do what Joseph Bankman, the Stanford Law professor who helped design California’s system, did and spend $30,000 out of pocket to hire a lobbyist to push the idea and counter Intuit’s lobbying.

    But for those of us without $30k to spare for the greater good, there’s a less demanding option: Stop paying for TurboTax.

    Now, if you have a relatively simple return without itemizations, I’m not going to argue that you shouldn’t use TurboTax for free. It, like most tax software, includes a free option for simple returns, or for households making under $62,000 a year. Using that is totally fine, as is using Free File Fillable Forms, a program offered by the tax prep companies in conjunction with the IRS that has a computerized version of the basic 1040 form. As long as you’re not giving any of your money to a tax preparation company, it’s all good.

    But resist the urge to pay for anything. Don’t pay for the state version. Don’t pay for one allowing for itemized deductions. Don’t pay for anything. Hell, don’t pay for Intuit’s other products like QuickBooks either if you can help it. Paying means putting money into Intuit’s pocket, which it can then turn around and use to lobby to make your taxes more complicated.

    If you have yet to file, don’t pay TurboTax a cent. If enough of us get on board, we might finally get to enjoy the return-free world we deserve.

    You can request more than one tax return on Form 4506 however, you must indicate the type of form you used to file each one, such as a Form 1040, 1040-SR, 1040A or 1040EZ. In the next section of Form 4506, you must provide the tax years you are requesting.     U.S. Sen. Elizabeth Warren, D-Mass., took a shot in July on Twitter at Intuit for exiting the Free File program and said the “IRS can, and should, create its own free tax preparation and filing system.”

    Back in early 2020, before the pandemic hit, the IRS said it was no longer promising not to enter the tax return software and e-file services marketplace. The pledge no longer exists for not creating a government-run system.

    Then, it seemed there could be a flicker of hope.

    The pandemic, though, hit the IRS hard. Shutdowns to stem the spread of COVID-19 in the spring of 2020 triggered delays in processing income tax returns and issuing refunds. The IRS also picked up extra work for rolling out Economic Impact Payments and later the advance Child Tax Credit to shore up the economy. It wasn’t pretty.

    Going forward, it only makes sense for the IRS to work harder to give taxpayers even more access to no-cost software options for those willing to do their own tax returns. Getting Congress to really simplify the tax code wouldn’t hurt, either.

    The top portion of the form requires you to enter your personal details as it appears on the original tax return you are requesting. At a minimum, the name and Social Security number you provide must match the original return. If you filed your original return jointly, you must include your spouses full name and Social Security number as well.

    If you are no longer married, its not necessary for your former spouse to sign Form 4506 or even provide consent. If youve moved since filing the return, you must also provide your current address. The IRS gives you the option of having the return sent directly to a third party if you provide their name, phone number and address.

    What Was The Big Criticism

    Big names, like Intuit’s TurboTax and H& R Block, faced much criticism back in 2019 after a ProPublica investigation detailed how the companies limited the program’s reach by making free options more difficult to find online and instead figuring out a way to steer eligible taxpayers into products that weren’t free.

    ProPublica’s reporting included pointing out that Intuit added code to the Free File landing page of TurboTax that hid it from search engines like Google, making it hard to find.

    In January 2020, the IRS announced some changes designed to offer more consumer protections.

    One such change: Tax preparation firms agreed that they would not exclude “Free File” landing pages from an organic internet search.

    The IRS suggested that taxpayers search for standard labeling: “IRS Free File program delivered by .”

    As part of IRS Free File, taxpayers cannot be offered bank products that often carry fees, such as high-cost refund anticipation loans.

    If you used IRS Free File last year, the company you used is required to send you an email welcoming you back to their official IRS Free File services.

    The email must include a link to the companys IRS Free File site and explain how to file with it. If you choose this email link and qualify, you will not be charged for preparation and e-filing of a federal tax return.
