If youre receiving unemployment benefits, its likely because youre out of work, and that could cause a hardship if you realize you have a lump sum of tax due when you file your return. For some taxpayers, this could mean deciding between paying the rent and buying groceries, or sending estimated tax payments to the IRS. If you find yourself in this situation, there are some options.

You can apply for a short-term or long-term installment agreement with the IRS to satisfy your tax debt in monthly payments made over a period of time, up to 72 months. Just file Form 9465 with the IRS.

You can also file Form 2210 with the IRS to ask the agency to waive any underpayment penalty thats been assessed against you if you feel it would be inequitable to require you to pay the penalty. You might also qualify for a waiver if you became disabled during the year you collected unemployment, or you retired during that year and were at least 62 years old.

What Happens If I Didnt Have Enough Taxes Withheld From My Unemployment Payments

If you didnt have enough taxes withheld from your unemployment payments, you will owe additional taxes when you file your tax return. If you owe more than $1,000 in total, you may have to pay a penalty for not having enough money withheld.

If you realize you didnt have enough taxes withheld during the same calendar year you received unemployment benefits you can either 1) make an estimated tax payment or 2) opt for higher withholding when you return to work.

How To Prepare For Income Taxes

Knowing that you may have to pay income taxes on your unemployment benefits, you can choose from several options to help make the payments more manageable.

  • Request tax withholdings. When you were working, your company may have withheld money for taxes and made those payments on your behalf. You can also ask your state to do the same with your weekly unemployment benefits. It will withhold 10% of your unemployment pay, which it will send to the IRS. You may also request state or local tax withholdings if they apply to you.
  • Pay estimated taxes. Another option is to make estimated tax payments to the IRS and your state tax agency every quarter. Depending on how much unemployment you collect, and what other sources of income you have throughout the year, you may want to do this even if you have money withheld from your benefits. If you wind up owing more than $1,000 in income taxes, you may have to pay an additional underpayment penalty.
  • Set money aside. You could choose to keep all your unemployment benefits if you donât expect to owe any taxes. Or, even if you expect to owe a little, you could still keep the money and set a portion aside in a savings account in case thereâs an emergency in the interim. An income tax calculator could help you estimate how much youâll want to set aside.

Already Filed A Tax Year 2020 Tax Return

In most cases, if you already filed a 2020 tax return that includes the full amount of your unemployment compensation, the IRS will automatically determine the correct taxable amount of unemployment compensation and the correct tax. If you paid more than the correct tax amount, the IRS will either refund the overpayment or apply it to other outstanding taxes owed or other debts. The IRS began performing the corrections starting in May 2021 and continues to review tax year 2020 returns and process corrections to issue any applicable refund that is due. If the exclusion of unemployment compensation now qualifies you for deductions or credits not claimed on your original return, you should file an amended return. For example, if you did not claim the Earned Income Tax Credit on your originally filed return because your AGI was too high, and the special exclusion allowed for unemployment compensation received in tax year 2020 reduced your AGI, you should file an amended return to claim the EITC if now eligible.

Exception: If you have qualifying children and received a CP08 or CP09 notice stating you may be eligible for the Additional Child Tax Credit or Earned Income Tax Credit, you do not need to file an amended return. Instead, you can simply respond to the notice if you are eligible for the credit.

  • Open or continue your tax return.

    Where To Find Your 1099

    We will mail a paper copy of your 1099-G to the address we had on file for you on December 31, 2021.

    We will start to mail out 1099-Gs in mid-January and will complete all mailings by January 31, 2022.

    It is too late to change your address for the 1099-G mailing, but you can access your 1099-G online.

    How Taxes On Unemployment Benefits Work

    Where Do I Enter Unemployment On Turbotax

    Unemployment benefits are income, just like money you would have earned in a paycheck. Youll receive a Form 1099-G after the end of the year, which will report in Box 1 how much youve received in the way of benefits. The IRS will receive a copy as well.

    You would have paid taxes on the full amount of your unemployment benefits if you filed your taxes before the ARPA was passed. The IRS issued a statement on March 31, 2021, urging taxpayers who had already filed not to file an amended return related to the new legislation. The IRS will recalculate and adjust all tax returns received prior to the ARPA that report unemployment income during the spring and summer of 2021 and will issue any resulting refunds.

    Youll have to pay taxes on the remaining amount if you received more than $10,200 in unemployment compensation. Your 1099-G will have the information youll need to transfer to your tax return.

    Unemployment compensation has its own line on Schedule 1, which accompanies your 1040 tax return. Youll transfer the amount in Box 1 of Form 1099-G to Line 7 of Schedule 1, and then the withholding amount in Box 4 of the 1099-G goes directly onto your 1040 tax return on Line 25b.

    The amount that was withheld will appear in Box 4 if you asked to have income tax withheld from your benefits.

    You must still report your unemployment compensation on your tax return, even if you dont receive a Form 1099-G for some reason.

    What If I Didnt Collect Unemployment Benefits In 2020 But I Still Received A Form 1099g

    Considering EDD has already confirmed its paid out more than $10 billion in fraudulent claims, there will certainly be tax forms going out to people whose identities have been used to file fake claims.

    If you get a form documenting funds you never received, EDD says to call 1-866-401-2849, but I would encourage people to use the online tool versus trying to call, said Amy Spivey, director of the UC Hastings Low-Income Taxpayer Clinic.

    You can report fraud on your 1099G form on EDDâs site. Just follow the topic boxes.

    If you feel there is an error on your 1099G form and cant get an amended one from EDD before filing time, make sure you dont report that income when you file your taxes.

    According to Spivey, if theres a mismatch between the earnings on your return and a 1099G the IRS has for you in its system, youll likely get a notice flagging underreported income. âAnd then at that point, you could respond directly to the IRS as well,â advised Spivey. The downside of that, she said, is that if youâre eligible for a refund, it could delay it.

    How Did Coronavirus Relief Legislation Change Benefits For 1099 Earners

    The Coronavirus Aid, Relief and Economic Security Act, which was passed in March 2020, allocated funds for expanded unemployment benefits during COVID-19. This included the creation of the Pandemic Unemployment Assistance program, Pandemic Unemployment Compensation , and Pandemic Emergency Unemployment Compensation .

    Since the passage of the CARES Act, self-employed people have typically been eligible for unemployment benefits. Eligibility has varied from state to state, so its important to check with your local labor office to see how it has implemented the CARES Act.

    States can provide PUA benefits to individuals who are self-employed. However, to qualify, you should not be able to apply for regular state unemployment benefits and be unemployed or unable to work due to circumstances related to the COVID-19 pandemic. The PUA program provides up to 39 weeks of benefits, but the benefits are only authorized through December 31, 2020. Notably, U.S. legislators could still extend PUA benefits in the future so people can use it for longer as the pandemic persists.

    If at any point, a self-employed individual that is receiving PUA benefits is able to restart their business or take on new work, they must report that income to their state unemployment office. The benefit amount they receive may decline, but workers do not want to run into legal trouble for receiving benefits while also being back to work.

    Employers Of Agricultural Employees

    Employers must pay Federal unemployment taxes if: they pay wages to employees of $20,000, or more, in any calendar quarter or, in each of 20 different calendar weeks in the current or preceding calendar year, there was at least 1 day in which they had 10 or more employees performing service in agricultural labor. The 20 weeks do not have to be consecutive weeks, nor must they be the same 10 employees, nor must all employees be working at the same time of the day.
