Filing Back Taxes In Canada

You should file your taxes on time. This is the best way to avoid interest charges, penalties, and additional hassle from the Canada Revenue Agency . However, for many reasons, people sometimes do not file their taxes when they should. Maybe you forgot or maybe you didnt realize that you needed to file. Maybe you did not file on purpose. Sometimes, people believe that its in their best interest to not file their taxes if they dont have the money to pay their tax debt. This isnt true, but its a common belief and it happens.

For whatever reason, if you didnt file your taxes when you should have, and now youre wondering how far back you can file taxes in Canada, the good news is that it is possible to file prior year returns.

Filing Itr For Previous Years

According to the Finance Act 1987 amendment, you can file your belated IT return anytime on or before 1 year from the end of the relevant Assessment Year . Example, for the AY 2016-17, the timeline to file a belated return was on or before 31 March 2018. With the amendment vide Finance Act 2016, from AY 2017-18 belated IT returns should be filed before the end of the relevant AY. Hence, for the FY 2019-20, the last day to file a belated return was 31 March 2021.

However, the Finance Bill 2021 has further reduced the timeline of filing the belated return. With effect from AY 2021-22, you can file the belated return three months before the end of the relevant assessment year or before the completion of the assessment, whichever is earlier. For example, the belated return for the FY 2020-21 can be filed up to 31st December 2021 . This date has been extended by CBDT to 31st March 2022 specifically for FY 20-21.

How To File The Missed Returns For Fy 2020

The amendment made in the Finance Act 2016 stated that income tax returns must be filed within the end of the relevant assessment year, effective from the assessment year 2017-18. There is no provision for you to file the returns once you have missed the due date. The income tax department allows taxpayers to file returns post-deadline in some specific cases. The following ways help you file a condonation of delay request:

  • Request the Income Tax Commissioner or the prescribed authority to permit you to file income tax returns and state the reason for missing the deadline. The officer can accept your request based on the following criteria:
  • The claim is correct and genuine.
  • The case is based on genuine hardship of merits.
  • A refund has resulted due to excess tax deduction, TDS, advance tax, or self-assessment tax.
  • Any other person cannot assess the tax under the Income Tax Act.
  • For such applications, the returns must be filed within a period of six years from the end of the assessment year for filing the return. For example, if you have missed filing returns on the due date of 31 March 2021, you can file such an application until 31 March 2026.
  • If you have not paid the tax for FY 2020-21, you must pay the tax along with applicable interest under Section 234A, 234B, or 234C. You must pay the tax even if you are unable to file your income tax returns.
  • An Offer In Compromise

How Do You File Previous Years Tax Returns

An offer in compromise is a bit more complex. It involves reaching an agreement with the IRS to pay less than your full balance due. An offer in compromise is typically only approved if youre unable to pay through an installment plan and comes with an application fee. Youll probably need the help of a professional for this option.

You must establish that you cannot pay your balance through an installment agreement or by any other means. All your past due tax returns must be filed before the IRS can grant you this relief, and you must have made some payment toward taxes in the current year, either through withholding from your paychecks or by sending in quarterly estimated payments, even though you havent filed a tax return for the year yet.

    Failure To File Taxes

If you fail to file your tax returns on time you may be facing additional penalties and interest from the date your taxes were due. Failure to file or failure to pay tax could also be a crime. The IRS recognizes several crimes related to evading the assessment and payment of taxes.

Under the Internal Revenue Code § 7201, any willful attempt to evade taxes can be punished by up to 5 years in prison and $250,000 in fines.

For most tax evasion violations, the government has a time limit to file criminal charges against you. If the IRS wants to pursue tax evasion or related charges, it must do so within six years, generally running from the date the unfiled return was due.

People may get behind on their taxes unintentionally. Perhaps there was a death in the family, or you suffered a serious illness. Whatever the reason, once you haven’t filed for several years, it can be tempting to continue letting it go. However, not filing taxes for 10 years or more exposes you to steep penalties and a potential prison term.

What Tax Documents Do I Need To File Back Taxes

When was the last year you filed? Do you have a copy of that tax return? Do you still have W-2s and other tax documents for the years you didn’t file?

You can request copies of your tax documents from the IRS if youre missing anything by filing Form 4506-T, or you can contact your employer or the institution that would have sent them to you.

Keep in mind that current or former employers or other establishments might not still have these documents on file, or at least they may not be easily accessible. There might also be a fee if you choose this option.

At a minimum, youll need Forms W-2 and 1099 for any income you brought in during the year in question, as well as specific tax returns and forms for that tax year. For example, you cant file a 2020 Form 1040 to report 2019 income. You should also gather supporting documentation of anything you spent that year that might be tax deductible or that will qualify you for tax credits, such as bank statements and credit card statements for that period of time.

Its best to use reliable and easy-to-use software if you’re going to prepare your tax returns yourself. Plan on spending a few hours on each tax return you have to file. There are tax software programs that can help you for free.

Again, make sure youre using software and forms for the appropriate tax year. Regulations vary from year to year, and the software settings can be critical for compliance as well as your liabilities or refund.

You might get a better result by hiring an experienced tax professional because they can help you with more complicated tax compliance and know how to deal with the IRS, if necessary.

Look for someone with significant experience in preparing back taxes if you decide to use the services of a professional. This would be the way to go if you need advice on handling incomplete tax documentation, or an advocate who will negotiate with the IRS on your behalf.

Youll need to print out the back tax returns and mail them in to the IRS to officially file them. You cant do it online.

    Put Your Documents In Order

You dont have to be told there will be a lot of paperwork to get your back taxes sorted. If you are filing personal returns, you must get your T4s and T5s. You can log in to the CRA website using the My Accounts feature to get copies.

You are liable to face penalties if you miss multiple tax slips. And if youve got credits to claim like medical and tuition, you have to get those records too. Self-employed Canadians or corporations can implement dedicated bookkeeping software to take care of documentation issues. You can also review your financial records to make sure your information is complete and in order.

Make sure you prepare draft returns for the years unfiled. The draft returns will give you some clarity about your situation and will help you make relevant choices regarding your unfiled returns.

Try to figure out in advance the best method to approach CRA concerning the total debt on your unpaid taxes. Understand that youre liable to pay penalties for late filing as well as interest on said penalties. If youre likely to shoulder a huge debt burden, think about ways to manage the debt without it affecting other areas of your life.

Remember that any kind of tax debt can tarnish your image in the eyes of lenders as well as creditors. It can also impact on your CPP, employment income, and pension.

As soon as youve completed your returns, double-check everything is in order and submit to the CRA.
