    If you file your return over 60 days late, youll have to pay a $435 fine or 100% of the tax you owe whichever is less.

    However, there is no penalty for filing a late return after the tax deadline if a refund is due, said the IRS.

    The tax season shocker for many jobless people will be that their tax refund could be far smaller than expected, or they might even owe taxes.

    Taxes arent withheld automatically from unemployment benefits. If you are unemployed in 2021, and receiving unemployment compensation, you may want to take action to have federal taxes withheld in the future.

    Look out for Form 1099-G, Certain Government Payments, to show how much unemployment compensation was paid to you in 2020. See Box 1 for the taxable income you must report on Line 7 on Schedule 1 of the 1040.

    All benefits are considered gross income for federal income tax purposes. This includes benefits paid under the federal CARES Act, Federal Pandemic Unemployment Compensation , state Extended Benefits , Trade Adjustment Assistance , Pandemic Unemployment Assistance , Pandemic Emergency Unemployment Compensation , and Lost Wages Assistance . DES reports these benefits to the Internal Revenue Service for the calendar year in which the benefits were paid.

    You may choose to have federal income tax withheld from your unemployment benefit payments at the rate of 10% of your gross weekly benefit rate , plus the allowance for dependents .

    The amount deducted for state income tax will be 10% of the amount deducted for federal taxes, which is currently calculated as 1% of the gross weekly benefit amount. Please Note: State income tax cannot be withheld from the $300 additional weekly benefit in Lost Wages Assistance and the $600 additional weekly FPUC benefit for regular UI claims. Claimants who received FPUC and/or LWA in regular UI will be responsible for paying any tax due on those amounts when filing state income taxes for calendar year 2020.

Both your weekly benefit amount and your additional Loss Wage Assistance, , and Federal Pandemic Unemployment Compensation, , are counted as benefits paid to you.

    However, this option may not be helpful if you have received benefits under several unemployment programs in 2020. This is because Claimants often have their claim summary page refreshed, for example, when filing a new claim for an extension of benefits or consideration of another benefit program.

    Todays the first day you can file for your tax refund and experts say you should file early. But tax time is also causing some trouble.

    Many of you who are collecting unemployment for the first time have encountered issues. WINK News walks you through getting the necessary documents.

    Many of you are wondering where to get your 1099-G form. According to its weekly update, the Department of Economic Opportunity says it sent claimants their personalized form by mail or made it available on CONNECT back in January:

    • The Department completed electronically processing 1099-G Tax Forms for all claimants on January 17, 2021. All claimants should have access to their 1099-G Tax Form in their CONNECT account.
    • Claimants who opted to receive communication from the Department through U.S. Mail should have received their 1099-G tax form no later than January 31, 2021. 1099-G Forms were also made available in CONNECT for these claimants on January 17, 2021.
    • If a claimant did not receive their 1099-G tax form by January 31, 2021, they received a 1099-G tax form by mistake, or their 1099-G tax form is incorrect, please for additional resources to obtain the form.
    • The Department has created Frequently Asked Questions to provide more information about the 1099-G Tax Form.

    If youre filing taxes unemployed this year, your household income will come into play. You may be unemployed, but your spouse may earn a salary. In this case, you have a choice. You can allow your spouse to file without you and file your own tax return, but if your salary is in the lower ranges, youll typically find youre better off filing jointly.

    With the current tax brackets, for instance, if your spouse made $50,000 during the tax year, the tax rate on those earnings will be 22 percent if he files separately. If, on the other hand, your spouse earns $50,000 and you file jointly, your tax rate will only be 12 percent.     Maybe. If the issue is corrected before the filing deadline then you will want to wait until your receive your corrected 1099-G form.

    But if the problem has not been corrected, the IRS advises that you may still file your federal income tax return, but to NOT place the amount that is listed in your 1099-G form. You will simply file your return without reporting your 1099-G information and you will need attach a statement to your tax return.

    The statement will need to include why you are not reporting the 1099-G income. A copy of the confirmation you will receive from the LWCs online fraud reporting form can serve as the written statement.

    What If I Dont Have The Funds To Pay My Tax Balance Due

    If you cant pay the full amount of taxes you owe, you should still file your return by the deadline and pay as much as you can to minimize penalties and interest. You can go online to irs.gov/payments or call the IRS at +1 800 829 1040 to see if you might qualify for a payment plan to pay off your balance over time. In some cases, the IRS may waive penalties if there is reasonable cause for the failure to pay timely. The IRS does not waive interest, however, so keep this in mind.     If you received unemployment benefits in 2020, the 1099-G form will be available in your Jobs4tn.gov account by January 31, 2020. You can access the form by visiting Unemployment Services and clicking on Form 1099-G Information. From here, you will be able to view the 2020 information as well as print off the form.

    Reporting Unemployment Benefits At The Federal Level

    For most states, you will receive Form 1099-G in the mail from your state unemployment office. Find out how you can obtain your 1099-G. On Form 1099-G:

    • In Box 1, you will see the total amount of unemployment benefits you received.

    • In Box 11, you will see the amount of state income tax that was withheld.

    You dont need to attach Form 1099-G to your Form 1040 or Form 1040-SR.

    In certain states, you will not automatically be mailed a Form 1099-G.
