Business Tax Credits In The United States

How to LEGALLY not pay income taxes

In the United States, there are a number of business tax credits and they often carry their intended purpose in the title. The Indian Employment Credit, for example, gives a tax credit to employers who hire Native Americans. Companies can also claim business tax credits clearly targeted at particular industries and sectors, like the Biofuel Producer Credit and the Orphan Drug Credit.

When filing, the General Business Tax Credit Form 3800 is used to tally up many of the separate tax credits for the purpose of determining the overall allowable credit. These credits must still be claimed individually using the specific form that can be found on the IRS website, or by consulting with an accountant or licensed tax professional. The available credits, as well as their applicable forms, may change from year to year, so it is important to consult with the IRS website before filing.

How The Wealthy Avoid Paying Tax

Recent weeks have seen a spate of stories about wealthy individuals trying to reduce their tax bills . The latest features a film investment scheme, Eclipse 35, on which HMRC refused to pay tax relief bad news for some famous names, according to reports. But other people have been more successful in their attempts to pay less tax. So how exactly do they do it? Here are few of the common methods used to cut the amount that ends up in the taxman’s coffers.

How These Strategies Apply To You:

While avoiding the capital gains tax may seem the obvious choice when structuring your estate, there are a few factors you should consider.

Most importantly, we always urge clients to make the right decision based on the totality of their current needs and future goals regardless of the incurrence of any capital gains tax. Some of the things you may want to consider are:

  • Do you need the money from the sale of your house in the near future, or can you wait to include it in your estate for heirs?
  • Do any of your children want the house, or would they prefer money? Will multiple children be able to work together amicably if gifted property to split?
  • Is most of your money tied up in your property, making it the main source of generational wealth transfer?
  • Are you single, or is your spouse still living and likely to outlive you?

As mentioned above, there has been some talk about possibly eliminating the step-up in basis. In effect, capital gains would be taxed, even on inherited assets. For now, however, these proposed changes are far from assured in fact, no details on any specific legislation have been released, much less presented or voted on in Congress.

At Cardinal, we emphasize education when it comes to our clients. We make sure you are well informed about all your options before making these important decisions. Laws can change. And even the most straightforward of estates can be made complicated by complex tax codes and opaque rules.

Example Of How Companies Use Business Tax Credits

Vast Majority of Americans Think Paying 50% of Your Income ...

Imagine ABC Corporation is in the process of filing their annual tax return. They are going through the list of available tax credits and have realized that they may claim the Credit for Employer-Provided Child Care Facilities and Services, since they have an on-site daycare. Using Form 8882, they list this credit. However, the amount of money that they are claiming is higher than this years allowable amount. Since this tax year was the first year they provided on-site daycare services, they can retroactively apply a portion of the credit to the prior tax year.

However, ABC Corporation is not done, and they have discovered that they are also able to claim some additional tax credits. Since they have maxed out their credits for this year, they will apply the remainder of those credits to the following tax year. With all the available business tax credits they were able to take this year, ABC Corporation owed a much smaller amount to the government this year. Next year, they will already have several credits to apply to their remaining obligation, even if they dont have any new tax credits to claim.

Request A Payment Extension

Filing a six-month tax-filing extension using Form 4868 won’t help. This extension only gives you more time to file your paperwork it doesn’t give you more time to pay what you owe.

Filing your return on time can help minimize the penalty and interest charges assessed by the IRS. The IRS’s late payment penalty is 0.5% per month, up to a maximum of 25% the late filing penalty is 5% per month, up to a maximum of 25%. So simply filing your return on time can save you a substantial amount in penalties.

If you believe you have a legitimate case due to undue hardship, you can file Form 1127 to request a six-month payment extension. Along with this form, you’ll have to submit a statement of all your current assets and liabilities and an itemized statement of all the money you’ve received and spent in the last three months.

The IRS rarely grants payment extensions, and it will only be granted if you can demonstrate undue hardship. If you just bought a 60″ flat-screen TV last month because you had no idea you were going to owe $5,000 in taxes, you’re not going to qualify for a hardship extension.

Health Insurance Premiums Deduction

If you are self-employed, pay for your health insurance premiums, and are not eligible to participate in a plan through your spouses employer, then you can deduct all of your health, dental, and qualified long-term care insurance premiums.

You can also deduct premiums that you paid to provide coverage for your spouse, your dependents, and your children who were younger than 27 at years end, even if they arent dependents on your taxes. Calculate the deduction using the Self-Employed Health Insurance Deduction Worksheet in IRS Publication 535.

Social Security And Medicare Taxes

It is important to note that the self-employment tax refers to Social Security and Medicare taxes, similar to Federal Insurance Contributions Act tax paid by an employer. When a taxpayer takes a deduction of one-half of the self-employment tax, it is only a deduction for the calculation of that taxpayers income tax. It does not reduce the net earnings from self-employment or reduce the self-employment tax itself.

Remember, youre paying the first 7.65% whether you are self-employed or work for someone else. And when you work for someone else, youre indirectly paying the employer portion because thats money that your employer cant afford to add to your salary.

Self-employed individuals determine their net income from self-employment and deductions based on their method of accounting. Most self-employed individuals use the cash method of accounting and will therefore include all income actually or constructively received during the period and all deductions actually paid during the period when determining their net income from self-employment.

Policymakers Should Bolster Irs Enforcement

The U.S. tax system relies on voluntary compliance, high levels of societal trust, and IRS enforcement as a backstop and deterrent. Historically, compliance has been relatively high compared to other countries, but there is an urgent need to rebuild the IRS enforcement function, particularly its ability to ensure that wealthy people pay the taxes they owe.

Policymakers have cut overall IRS enforcement funding by 25 percent since 2010, after adjusting for inflation, and the enforcement division has lost roughly 30 percent of its workforce. These cuts have taken a severe toll. For example, the IRS audited just 3.2 percent of millionaires in 2018, down from 8.4 percent in 2010.

The cuts in IRS enforcement occurred even as highly publicized scandals underscored the lengths to which some wealthy individuals will go to evade taxes. As a report from the Senates Permanent Subcommittee on Investigations noted in 2008:

Each year, the United States loses an estimated $100 billion in tax revenues due to offshore tax abuses. Offshore tax havens today hold trillions of dollars in assets provided by citizens of other countries, including the United States. The extent to which those assets represent funds hidden from tax authorities by taxpayers from the United States and other countries outside of the tax havens is of critical importance.

Understanding Business Tax Credits

Business tax credit is a generic way of referring to tax credits aimed at spurring a particular type of corporate action. Business tax credits can come in many forms, but some of the common business tax credits are aimed at activities like hiring employees who face barriers to employment, investing in research, upgrading a building to be more efficient, and so on. The fact that a business tax credit exists for an activity means that the government is seeking to reward and encourage that activity.

Unlike an allowable deduction, business tax credits are targeted. This is because they represent more of a tax reduction opportunity for businesses, which corresponds directly with less tax revenue for the government. It is in the best interests of a business to use all credits that it is qualified for to reduce the amount of money owed the federal government come tax time.

When A Dependent May Need To File A Tax Return

Taxpayers who are claimed as a dependent on someone’s tax return are subject to different IRS filing requirements, regardless of whether they are children or adults. A tax return is necessary when their earned income is more than their standard deduction.

The standard deduction for single dependents who are under age 65 and not blind is the greater of:

  • $1,100 in 2021
  • Or the sum of $350 + the person’s earned income, up to the standard deduction for an unclaimed single taxpayer which is $12,550 in 2021.

A dependent’s income can be “unearned” when it comes from sources such as dividends and interest. When a dependent’s unearned income is greater than $1,100 in 2021, the dependent must file a tax return.

Rental Property Is Less Passive

The rich do not pay the most taxes, they pay ALL the taxes

The only thing about owning rental property is that it scores low on the passive investing scale. The older and richer you get, the less you want to deal with maintenance and tenants.

This is where investing in real estate crowdfunding platforms like Fundrise and CrowdStreet, my two favorites, come in. Real estate crowdfunding allows you to invest in commercial real estate around the country with potentially higher returns without any grunt work.

For example, there is huge valuation and cap rate differences today between expensive coastal city real estate and heartland real estate. With real estate crowdfunding, an investor can arbitrage the valuation and cap rate differential for potential profits.

Theres no reason employees need to be stuck paying $4,500 a month for a crappy two-bedroom apartment in San Francisco or Manhattan when they can rent a massive house for half the price in Austin, Texas.

Choose The Best Employment Status

Are you employed or self-employed? As noted the previous tip, there are considerable advantages to being self-employed in terms of tax planning, yet this can also have disadvantages. For example, it can limit the tax relief available on pension contributions. Its worth getting expert advice to determine the most suitable employment status for your situation.

Invest In Municipal Bonds

Buying a municipal bond essentially means lending money to a state or local governmental entity for a set number of interest payments over a predetermined period. Once the bond reaches its maturity date, the full amount of the original investment is repaid to the buyer.

Interest on municipal bonds is exempt from federal taxes, and may be tax exempt at the state and local level as well, depending on where you live. Tax-free interest payments make municipal bonds attractive to investors.

Municipal bonds historically have lower default rates than their corporate bond counterparts. A study of municipal bonds from 1970 to 2019 found that the default rate was 0.1% for investment-grade municipal bonds versus 2.25% for global corporate issuers.

However, municipals typically pay lower interest rates. Because of the tax benefits, municipal bonds tax-equivalent yield makes them attractive to some investors. The higher your tax bracket, the higher your tax-equivalent yield.

How Much Can You Inherit And Not Pay Taxes

How Not to Pay Federal Income Tax

Even with the new proposed rules from Bidens lowered exception, estates under $6 million wont have to worry about federal estate taxes for a few yearsalthough state estate tax exemptions may be lower. However, what about inheritances and what about inherited IRAs? This is explored in a recent article titled Minimizing Taxes When You Inherit Money from Kiplinger.

If you inherit an IRA from a parent, taxes on required withdrawals could leave you with a far smaller legacy than you anticipated. For many couples, IRAs are the largest assets passed to the next generation. In some cases they may be worth more than the family home. Americans held more than $13 trillion in IRAs in the second quarter of 2021. Many of you reading this are likely to inherit an IRA.

Before the SECURE Act changed how IRAs are distributed, people who inherited IRAs and other tax-deferred accounts transferred their assets into a beneficiary IRA account and took withdrawals over their life expectancy. This allowed money to continue to grow tax free for decades. Withdrawals were taxed as ordinary income.

The SECURE Act made it mandatory for anyone who inherited an IRA to decide between two options: take the money in a lump sum and lose a huge part of it to taxes or transfer the money to an inherited or beneficiary IRA and deplete it within ten years of the date of death of the original owner.

Substantial Income Of Wealthy Households Escapes Annual Taxation Or Enjoys Special Tax Breaks

Reform Is Needed

With the nations income and wealth highly concentrated at the top and growing more so in recent decades, policymakers should reconsider how the tax code treats the most well-off. High-income, and especially high-wealth, filers enjoy a number of generous tax benefits that can dramatically lower their tax bills. Eliminating or limiting these preferences would make the tax code more progressive and push back against inequality. It also would raise significant revenue that could be used to fund key priorities and help address the nations fiscal challenges.

Further, a significant part of the income that does show up on wealthy households annual tax returns is taxed at preferential rates. Capital gains and dividends are taxed at a maximum income tax rate of 20 percent, far below the 37-percent top rate on wages and salaries. Also, the 2017 tax law created a new 20-percent deduction for certain pass-through business income , which lowers the tax rate on this income by up to 7.4 percentage points. The deduction disproportionately benefits wealthy people: 61 percent of the benefit will ultimately flow to the top 1 percent of households, the Joint Committee on Taxation estimates. The 2017 law also slashed the corporate rate from 35 percent to 21 percent, which disproportionately benefits wealthy shareholders.

Policymakers have a number of ways to raise more revenue from the most well-off. They fall into two broad categories:
