  • ITINs let more people pay into the system, which builds the tax base. According to the IRS, in 2015, 4.4 million ITIN filers paid over $5.5 billion in payroll and Medicare taxes and $23.6 billion in total taxes.
  • ITIN holders are not eligible for all of the tax benefits and public benefits that U.S. citizens and other taxpayers can receive. Because ITIN holders are eligible for the CTC, the IRS estimated in 2014 that up to 4 million U.S.-citizen children of ITIN holders benefit from the tax credit. If a child does not have a SSN, he or she is not eligible for the tax credit.

The Internal Revenue Service tries to plan for all contingencies when writing regulations. When the agency began requiring Social Security numbers for all dependents, it recognized that there were a limited number of people for whom this simply wouldnt work. The IRS quickly wrote regulations to cover situations involving dependents who couldnt meet the requirements to obtain a Social Security number. However, with only one exception, your dependents must have one of the three types of acceptable identification numbers.

Vincenzo Villamena, managing partner of a firm that provides tax planning help for Americans living overseas and others with special situations, says the easiest thing to do is to simply file a joint return, treating a nonresident spouse as a resident, if necessary. But for long term tax planning, this might not be the most beneficial move, he says.

That’s because the money you would save by a dependent might be less than the additional tax you would have to pay because all of your spouse’s worldwide income will be subject to U.S. tax. Every case is different in this situation, Villamena says, so it pays to run the numbers using different options and see what saves you the most money.

How To File Taxes Without A Social Security Number Irs Form W7

To file a return electronically, the IRS requires a Social Security Number or an Individual Taxpayer Identification Number for each person listed on your return. If you, your dependent or spouse does not have a SSN, then you must list the ITIN instead of a SSN. If you, your spouse, or one of your dependents does not have one of these numbers, one must be applied for.

If you have already applied for one of the approved numbers and have not received it yet, you still cannot e-file your return. You must either wait until you receive the number and then e-file, or you must file on paper and follow the IRS 1040 instructions for this. A SSN or ITIN must be listed for each person on the return to be able to file electronically.

  • Have the employee fill out an I-9 form
  • Complete new hire reporting requirements
  • After your employee begins working, be sure to add them to payroll and withhold payroll taxes from their wages.

    If an employee does not receive an SSN or gets turned down for one, they cannot legally work for you.

    Do not accept an ITIN in place of an SSN. An ITIN cannot be used for employee identification or work. ITINs are only available to resident and nonresident aliens who are not eligible to work in the U.S.
