You may also want to contact the IRS to see if you can have any penalties waived through the first-time penalty abatement program, reasonable cause relief or statutory exception. You may qualify for the first-time penalty abatement program if you have not had penalties assessed to your account for the prior three years, you have filed all tax returns or filed an extension and you have paid or made arrangements for any taxes due.

If you do not qualify for the first-time penalty abatement, you may want to consider penalty relief through a reasonable cause. The IRS will consider your request if you can establish the following reasonable causes:

  • You experienced a fire, casualty, natural disaster or other adverse weather conditions
  • You are unable to obtain your financial or tax records
  • You or an immediate member of the taxpayers family were impacted by a serious illness or death

Finally, you may also request penalty relief if you received incorrect written advice from the IRS, you may request relief through statutory relief. You will need to file a Form 843, Claim for Refund and Request for Abatement to request for penalty relief. Your form should include the written advice you relied on, the amount of taxes and penalties related to the advice.

Your Rights When It Comes To Collection Activities

It is important to remember that the IRS makes mistakes. The IRS saying you owe a specific amount in back taxes does not mean that their figures are correct. Most importantly, you need to remember: You as a taxpayer have a right to due process. While your former spouse may be guilty of wrongdoing, you may still receive innocent spouse relief.

CRA will make payment arrangements if you can repay your total taxes within one year. If youve been working with a CRA collection officer, be honest with them about your situation. Propose a tax installment plan that is both fair and affordable.

If you owe substantial penalties & interest, but can afford to repay the underlying tax debt, you can work with a tax lawyer to negotiate a reduction in penalties and interest. However, CRA will not negotiate a private tax settlement either directly with the tax payer or through a tax lawyer in Canada that does not see the total taxes owing paid in full.

CRA may request faster payment. You can consider taking out a loan to pay CRA, however, this will depend on your credit capacity and credit score.

Once you have a deal you can make your payments online but be sure you make all agreed upon payments in full and on time.

    Request An Offer In Compromise

    An offer in compromise allows you to offer a lower amount to the IRS, and if approved, the IRS will forgive the remaining balance. However, you must qualify for the OIC.

    Before the IRS approves an OIC, it will consider a few factors, which include your ability to pay, your income, expenses and your asset equity.

    Your asset equity is determined by subtracting any amount owed to creditors or others from the value of an asset. For example, if your investment property is worth $250,000 and you have a mortgage of $175,000, your asset equity is $75,000.

    To qualify for an OIC, the IRS requires you to be current with both your tax return filings and estimated tax payments. Also, if you are a business owner and have employees, the IRS requires you to make all federal employment tax payments for the current quarter to qualify. You must also demonstrate you are unable to pay the full balance through alternative options, such as an installment agreement or other financial means. If you are in the process of filing bankruptcy, you cannot enter into an OIC with the IRS.

This tool guides you through questions about your financial information and tax filing status to determine a potential offer amount. But it should only be used for informational purposes. The IRS bases its decision on your completed application, Form 656, and its preliminary investigation.

    File Bankruptcy And Include Your Tax Debts

    If most of your debt is tax debt, bankruptcy is not typically the best option. Most people that qualify for a bankruptcy qualify for an Offer In Compromise. The Offer is better on your credit and in many cases tax liens can get completely withdrawn like they never existed, while bankruptcy will be on your record for some time.

    If You Dont Repay Your Loans

    If you don’t make your loan payments, you will be in default.

    An OSAP loan is considered to be in default when no required payments have been made for 270 days.

    Being in default means:

    • your debt will be turned over to a collection agency
    • you will be reported to a credit bureau
    • you could be ineligible for further OSAP until the default is cleared
    • your ability to get a car loan, mortgage or credit card can be affected
    • your income tax refund and HST rebate can be withheld
    • interest will continue to build up on the unpaid balance of your loan

    Your OSAP debt will only be erased when you have paid it off in full.

    What To Do After You Find Out

    Lets say youve decided on a method to check if you owe taxes. What you should do now is act quickly. You dont want to be on the bad side of the IRS. A problem worth a few thousand dollars can quickly become tens of thousands of dollars if you dont do anything.

    Below are possible consequences of not paying the debt owed:

    How To Find Out How Much You Owe The Cra

    The first step in determining how much you owe CRA is to file back tax returns. Filing late will increase your tax debt, making it harder to deal with. The deadline for filing personal income tax returns in Canada is April 30. If you have self-employment income you have until June 15 to file your taxes. The penalty for filing a tax return late is 5% of the balance owing, plus 1% for each full month your return is late, to a maximum of 12 months.

    That sounds simple, but many people are afraid to file their income tax return because they expect a big tax liability. However, you cannot proceed with any solution for unpaid taxes until you know how much CRA taxes you owe. Not filing at all is not an option as the CRA will not deal with you if you have outstanding unfiled tax returns.

    Once your return is filed for each tax year, CRA will issue a Notice of Assessment confirming your taxes for the years filed. They will add any penalties and interest. If you owe taxes a letter will ask you to either arrange payment or contact the CRA.
