For those looking for free fillable forms, the Virginia Department of Taxation said the software provider no longer offers them for individual income tax filing. People will have to use other filing options.

Individual Income Tax Filing Due Dates

  • Fiscal year filers: Returns are due the 15th day of the 4th month after the close of your fiscal year.

If the due date falls on a Saturday, Sunday, or holiday, you have until the next business day to file with no penalty.

How Can I File My Return

The Virginia Department of Taxation has a list of e-filing options on its website. For people who want to file by mail, the department has a list of forms you may need.

Refund returns will need to be sent to the Virginia Department of Taxation, P.O. Box 1498, Richmond, VA 23218-149. Tax due returns will need to be sent to the Virginia Department of Taxation, P.O. Box 760, Richmond, VA 23218-07608.

The department said e-filed returns are typically processed within two weeks, while mailed returns may take up to eight weeks or longer to process.

Individuals under age 70 on or before Dec. 31 of the taxable year can enter $4,000 or the amount they contributedwhichever is lessto each Virginia529 account during the taxable year. Those age 70 or older on Dec. 31 can deduct the entire amount contributed during the taxable year.

RICHMOND, Va. – Virginia Tax is reminding taxpayers in Virginia, if you havent yet filed your individual income taxes, the filing and payment deadline is coming soon. You have until Monday, May 2, 2022, to submit your return. Taxpayers can watch a new video on filing options, follow us on or for updates, and find detailed information on our website.

This year, the Virginia filing deadline falls on the first business day after Sunday, May 1, said Tax Commissioner Craig M. Burns. We are, as always, encouraging you to file electronically and request a refund, if you have one coming, via direct deposit.

Electronically filed returns are typically processed within two weeks, while mailed returns may take up to eight weeks or longer to process.

Here is some other important information to keep in mind:

  • No penalties or interest will apply so long as a return is filed and full payment is made by the deadline
  • If your income was $73,000 or less in 2021, youre eligible to file your taxes for free
  • If you miss the filing deadline, Virginia has an automatic, 6-month filing extension. No application is required. You still need to pay any taxes owed on time to avoid additional penalties and interest and
  • If you do need to make a payment, you have several easy-to-use options available including online, directly from your bank account check or money order and credit or debit card, both of which incur an additional fee.

Virginia has moved the deadline for filing 2020 individual tax returns to May 17, aligning the Virginia due date with the new due date for federal returns. Last week, the IRS gave individual taxpayers until May 17 to file their 2020 federal returns.

While many taxpayers will benefit from this extra time, others will not. How will this change affect your tax filing deadlines?

Virginia Income Tax Deadline Extended To May 17

RICHMOND, Va.

After a national extension of the federal tax deadline, Virginia Gov. Ralph Northam said the state Department of Taxation would extend the 2021 deadline for filing individual income taxes to May 17.

That’s the same date to which the IRS pushed back the federal tax filing deadline.

In a Friday afternoon release, Northam said this would help simplify the process for Virginians – but if they could file before mid-May, that was still a good idea.

“Even with this extended deadline, we encourage Virginians to file as soon as possible so we can get people the refunds they are entitled to while also protecting the Commonwealths strong fiscal footing,” he wrote.

Of note – if you owe taxes, you need to make those payments by the new May 17 deadline to avoid penalties.

“While interest may still accrue beyond the original deadline, legislation to address this issue will be considered at Aprils reconvened session,” the governor’s office wrote.

Tax Commissioner Craig Burns encouraged tech-savvy Virginians to file their taxes online this year, if that was an option.

Filing electronically is the fastest and most efficient way to submit your return, get it processed and get your refund, Burns wrote in the release. Due to the COVID-19 protocols that are in place, it could take longer for us to process paper returns.

Virginia is also delaying the payment deadline for state sales taxes due from retailers on Friday by 30 days, until April 20. The payments are due quarterly.

The delay will impact municipalities, which receive their due share of payments through the state. Businesses can apply for the relief from the states tax agency, though Layne said deferrals will be granted liberally.

Those businesses that can pay, like Amazon, we expect them to pay on time, he added.

Delayed payments will still be subject to interest, but Layne said the state would push for relief from those when lawmakers reconvene April 22.

Already, some state lawmakers are arguing that a longer delay is a critical part of helping individuals and businesses in Virginia recover.

House Republican leaders asked Gov. Ralph Northam to emulate the federal government and, at a minimum, issue a 90-day tax payment extension in a letter sent Thursday.

The letter was signed by House Minority Leader Todd Gilbert, R-Shenandoah, and Dels. Kathy Byron, R-Bedford, and Jay Leftwich, R-Chesapeake.

When Can I Expect My Refund

If you file electronically and choose direct deposit, the IRS says you can expect your refund within 21 days, assuming there are no problems with your return.

The IRS has already processed more than 70 million returns for fiscal 2021 and issued nearly 52 million refunds. But the agency has also warned about delays in processing returns, especially as the 2022 tax season involved complications like stimulus payments and an expanded child tax credit.

“The pandemic continues to create challenges, but the IRS reminds people there are important steps they can take to help ensure their tax return and refund don’t face processing delays,” IRS Commissioner Chuck Rettig said in a statement.

Experts agree direct deposit is the fastest way to get your refund from the IRS.

Missed The Filing Deadline

Virginia grants an automatic 6-month extension to file your individual income tax return. However, the extension does not apply to paying any taxes you owe.

If you missed the deadline, and owe taxes, you should pay as much as you can as soon as possible to reduce additional penalties and interest.

Your options:
  • If you havent filed your return, you should file and pay as soon as possible.
  • If youre still not ready to file your return, make an extension payment online using the eForm 760IP or by check. If paying by check, be sure to include the 760IP voucher with your payment. To determine how much to pay, use the worksheet on the back of the Virginia Automatic Extension Payment Voucher for Individuals .
  • If you filed your return on time, but didnt pay the taxes you owed, you should pay as much as you can now to reduce penalties and interest later. You have a number of payment options, both online and by check. If paying by check, be sure to include the 760-PMT voucher with your payment.

In all cases, you should pay as much as you can to reduce the amount of penalty and interest youll owe.

If you cant pay the full amount that you owe, well send you a bill to collect the remaining amount due, along with any penalty and interest. Once you have a bill, you can call to set up a payment plan.

What Day Are Partnership Returns Due

The day of the year varies by whether you file your taxes in calendar year. We typically use the calendar year as our year-end accounting system. Generally, after the end of a tax year, partnership tax returns must be filed by the 15th of the third month. Form 1065, U.S., can be found here. Partnership income must be reported to the IRS.

States With Tax Deadlines After April 15 In 2019

Virginia is one of only two states that push the deadline for state income tax returns into May. Residents of the Old Dominion have until May 1, 2019, to file their 2018 Form 706.

The Commonwealth allows an automatic six-month filing extension for taxpayers who miss the deadline. No application for the extension is required. However, you must pay at least 90% of your Virginia tax by the May 1 due date to avoid a penalty.

We recommend filing both federal and state returns at the same time if possible. State returns typically “piggyback” off the federal return, so it’s usually easier to do them at the same time. There’s also a better chance of avoiding discrepancies if you do them together. However, if that’s not possible, having some extra time to file your Virginia return can help. It gives you more time to focus on getting your federal return off before the April 15 deadline and then to get your state return just right.
