A taxpayer whose installment agreement is monitored by the IDRS will receive Notice CP 523, Defaulted Installment Agreement Notice of Intent to Levy. A defaulted installment agreement may be reinstated without manager approval if it is determined that the agreement was terminated because of an additional liability and if addition of that new liability will result in no more than two additional monthly payments and the agreement will not extend beyond the Collection Statute Expiration Date , and Terminated Installment Agreements).

    When You Cannot Pay In Instalments

    You cannot set up a Time to Pay arrangement if HMRC do not believe you will follow a repayment plan. For example, if you have not paid taxes in the past.

    If HMRC cannot agree a payment plan with you, theyll ask you to pay the amount you owe in full. They can collect unpaid tax directly if you refuse to pay.

    What If The Requested Tax Instalments Total Less Than I Owe

    CRA wont charge you interest for whatever additional tax you owe, so long as you paid the requested amounts. In other words, its not your responsibility to predict that the tax instalments werent high enough. Youre only responsible for paying the lesser of a) what you owe, or b) what CRA requested of you.

    If you want to play it safe, always pay the requested amount. If it turns out to be too much, youll get a refund when you file, or a credit toward next years taxes. Nothing gets lost.

  • If you are unable to revise an existing installment agreement online, call us at or . If you have received a notice of default and cannot make changes online, or you received an urgent notice about a balance due, follow instructions listed on the letter and contact us right away.

    As Part Of The Agreement The You Must:

    • File and pay all tax returns in full: The taxpayer must continue to file and pay all tax returns in full during the entire term of the installment payment agreement.
    • File and pay estimated income taxes: The taxpayer must remain current in paying estimated income taxes, and enter the correct filing status and number of allowable exemptions on their NC-4s.
    • Provide additional information, as needed: The taxpayer must provide the Department with any additional information if requested. The Department may perform periodic reviews of the taxpayer’s financial condition during the term of the agreement to determine continued need as well as possible jeopardy of collection.

    If you cannot meet these requirements when the agreement is set up, or any additional requirements thereafter, the agreement will be in default.     If You Can Pay Your Debt Over Time An Installment Plan May Be The Right Solution

    The most widely used method for paying an old IRS debt is the monthly installment agreement, or IA. If you owe $50,000 or less, you should be able to get an installment payment plan for 72 months just by asking for it. If you owe more than $50,000, you will have to negotiate with the IRS to get one and provide financial information. As part of its Fresh Start program, the IRS recently adopted new rules making it easier to obtain an installment agreement. The threshold for qualifying for an installment agreement without having to provide financial information was increased from $25,000 to the current $50,000 amount and the timeline for paying was increased to 72 months from 60 months.

    You must be current on this yearâs tax returns. If IRS computers show that you havenât filed all past due tax returns, you will not be eligible for an IA. Likewise, if you are self-employed, you must be current on your quarterly estimated tax payments for the current year. Finally, if you have employees, you must be current on payroll tax deposits and Form 941 filings to get an IA.

    But donât assume that a payment plan is your best option â there are definite drawbacks. The biggest is that interest and penalties continue to accrue while you still owe. Combined with penalties, the interest rate is often 8% to 10% per year. Itâs possible to pay for years and owe more than when you started.
