This is one of the great little secrets about the federal tax law. If you have a refund coming from the IRSas about three out of four taxpayers do every yearthen there is no penalty for failing to file your tax return by the deadline, even if you don’t ask for an extension. However, this might not be the case for state taxes.

That’s not to say there aren’t very good reasons for filing on time. Even if you have a refund coming, consider the following:

  • You can’t get your money back until you file, so you should file as soon as you can to get your money as soon as possible.
  • The statute of limitations for the IRS to audit your return won’t start until you actually file your return. So, the sooner you file, the sooner the clock starts ticking.
  • Some tax elections must be made by the due date, even if you have a refund coming. This applies to a very tiny percentage of taxpayers.

How Much Tax Penalties Cost

There are two possible penalties you could pay if you owe back taxes:

  • A failure-to-file penalty when you file late. Itâs worth 5% of your unpaid taxes and it accrues each month until it reaches 25% of your unpaid taxes. If you are owed a refund from the IRS, you wonât have to pay this penalty.

  • A failure-to-pay penalty applies any time you donât pay your full tax bill on time. Itâs worth between 0.5% and 1% of your unpaid taxes, accruing each month until it reaches 25% of your unpaid taxes. You donât have to pay this tax if youâre getting a tax refund from the IRS.

If you continue not to pay your taxes, the amount you owe could come out of future tax refunds, and the IRS could even put a lien on your assets or property. Read more about the tax penalties for filing your taxes late.

How Do I File Back Tax Returns

You can use TaxSlayer to file a return for up to three years after it is due. So for example, in 2021, you can file back taxes for years 2017, 2018, and 2019.

Simply log into your account or create a new account to begin. Then click on the Prior Years tab in the middle of the My Account page. Select the year you wish to create and click Start a New Tax Return. From there, youll enter the income and expense information for the year you are filing.

Once your return is complete, you will need to print out and mail in the paper copies of your forms. This is because the IRS does not support filing prior year returns electronically. The mailing address for the IRS can be found here based on the state where you live.

Filing Past Due Tax Returns

  • Tax Exempt Bonds
  • File all tax returns that are due, regardless of whether or not you can pay in full. File your past due return the same way and to the same location where you would file an on-time return.

    If you have received a notice, make sure to send your past due return to the location indicated on the notice you received.

    An extension of time for payment of tax can be filed with the IRS on Form 1127: Application for Extension of Time for Payment of Tax, but the legal requirements are strict:

    • Form 1127 must be received by the IRS on or before the date that the tax is due.
    • You must provide a complete statement of all your assets and liabilities at the end of the last month, and an itemized list of money you received and spent for the three months immediately prior to sending in the extension to pay request.
    • You must demonstrate that paying the tax when due would result in undue hardship simple inconvenience is not enough of a hardship to qualify.
    • You need to show that paying the tax when due would result in a substantial financial loss and that you don’t have the cash, or can’t raise the money, by selling property or through borrowing.

    When approved, extensions to pay are generally limited to six months. Plus, the IRS requires some acceptable form of security before granting an extension of time to pay. The security may be in the form of a bond, notice of lien, mortgage or other means, depending upon individual circumstances.

    Collection And Enforcement Actions

    The return we prepare for you will lead to a tax bill, which, if unpaid, will trigger the collection process. This can include such actions as a levy on your wages or bank account or the filing of a notice of federal tax lien.

    If you repeatedly do not file, you could be subject to additional enforcement measures, such as additional penalties and/or criminal prosecution.
