Small Business Income Estimated Tax Payments

New York State Enhanced Fill-in Tax Forms

For tax year 2021, a taxpayer is not required to remit SBI estimated tax payments. The department will not assess a penalty for underpayment of estimated taxes on any amount not remitted.

Note: The taxpayer is still subject to the late payment penalty for the amount of taxes not paid by the original due date of the return. The department will not assess a late filing penalty on the SBI tax return. If the taxpayer fails to timely file the SBI tax return , the election will be denied and the adjustment made on the regular tax return for small business income will be disallowed. In this case, all income is reported on the regular income tax form.

Beginning with tax year 2022, a taxpayer is required to pay estimated tax in four equal installments if the taxpayers liability is at least $1,000. Use Form 140ES-SBI, Individual Estimated Income Tax Payment , to remit the required amount of quarterly estimated taxes. Page 2 of Form 140ES-SBI includes a worksheet to determine the required amount of each quarterly tax payments.

For TY 2022, the tax is equal to 3.0% of small business taxable income reported on the SBI tax return.

The amount of the required payment is the lesser of:

  • 90% of the tax shown on the return for the TY or, if no return is filed, 90 percent of the tax for that year
  • If the taxpayer fails to remit the required estimated tax payment , the department may assess an underpayment of estimated taxes penalty on any amount not timely remitted.

    Calculating Your Amount Due

You can reduce your state tax liability by any state tax credits that you qualify for. State credits can vary widely, but many states have their own versions of child tax credits and earned income credits.

Most tax credits can only reduce your tax liability to zero. They’re treated as payment toward any tax you owe.

Some credits are refundable. Any leftover credit after eliminating your tax debt would be sent to you as a tax refund.

Composite Income Tax Return In Another State

A small business taxpayer who participates in a composite income tax return in another state may claim a credit for taxes paid to the other state if the taxes paid to the other state are imposed on and paid directly by the small business taxpayer and not the entity and if the:

  • Small business taxpayer makes direct payment to the other state
  • Small business taxpayer makes direct payment to the entity filing the composite income tax return
  • Entity charges the small business taxpayer’s loan account for the amount of the tax and
  • Entity reduces the small business taxpayer’s capital account.
  • If the taxpayer claims the credit for taxes paid to a foreign country, to use the conversion rate in effect on the date the taxpayer paid the taxes to the foreign country.

If any taxes paid to another state or country are credited or refunded and the taxpayer has been allowed a credit, to immediately report that fact to DOR.

If any taxes paid to another state or country are credited or refunded, a tax equal to the credit allowed for the taxes credited or refunded by the other state or country to be paid by the taxpayer on notice and demand from DOR.

States With No Individual Income Tax

Fillable Delinquent Use Tax Return Form

Nine U.S. states do not level a broad-based individual income tax. Some of these do tax certain forms of personal income:

  • Alaska â no individual tax but has a state corporate income tax. Like New Hampshire, Alaska has no state sales tax, but unlike New Hampshire, Alaska allows local governments to collect their own sales taxes. Alaska has an annual Permanent Fund Dividend, derived from oil revenues, for all citizens living in Alaska after one calendar year, except for some convicted of criminal offenses.
  • Florida â no individual income tax but has a 5.5% corporate income tax. The state once had a tax on “intangible personal property” held on the first day of the year , but it was abolished at the start of 2007.
  • Nevada â has no individual or corporate income tax. Nevada gets most of its revenue from sales taxes and the gambling and mining industries.
  • Tennessee has a “Hall income tax“, levied at a rate of 3% on income received from stocks and bonds not taxed ad valorem as of 2019. The tax is 2% as of 2020, 1% as of 2021, and fully repealed as of 2022. In 1932, the Tennessee Supreme Court struck down a broad-based individual income tax that had passed the General Assembly, in the case of Evans v. McCabe. However, a number of Attorneys General have recently opined that, if properly worded, a state income tax would be found constitutional by today’s court, due to a 1971 constitutional amendment.
  • Wyoming has no individual or corporate income taxes.

Getting Started With Your State Income Taxes

Whether you e-File or file by paper, planning ahead will help you avoid problems and delays with your income taxes.

First: View the Individual Income Filing Requirements to determine if you should file a North Carolina individual income tax return.

Second: determine your federal adjusted gross income, which is the starting point for your State individual income tax return. You determine that figure by completing a federal income tax return. Visit the Internal Revenue Service webpage to help you get started with your federal return.

Once you have determined that you should file, review these tips to give you a head start on your State income taxes:

  • Review the instructions on how to file your State taxes.
  • Gather your records in advance. Make sure you have all the records you need, including wage and tax statements from employers, retirement distribution statements from pension payers, and interest and dividend statements from financial institutions. Dont forget to save copies for your files. Filing before you receive all your records could cause you to have to file an amended Form D-400.
  • Remember: Please don’t file photocopies of tax forms. That could delay the processing of your return or cause errors that would require you to file an amended return.

Choose The Right Income Tax Form

Your residency status largely determines which form you will need to file for your personal income tax return.

If you are a Maryland resident, you can file long Form 502 and 502B if your federal adjusted gross income is less than $100,000.

If you lived in Maryland only part of the year, you must file Form 502.

If you are a nonresident, you must file Form 505 and Form 505NR.

If you are a nonresident and need to amend your return, you must file Form 505X.

If you are a nonresident employed in Maryland but living in a jurisdiction that levies a local income or earnings tax on Maryland residents, you must file Form 515.

    Special situations

If you are self-employed or do not have Maryland income taxes withheld by an employer, you can make quarterly estimated tax payments as part of a pay-as-you-go plan, using Form PV. Please refer to Payment Voucher Worksheet for estimated tax and extension payments instructions.

If you owe additional Maryland tax and are seeking an automatic six-month filing extension, you must file Form PV along with your payment by April 15, 2020. You should file Form PV only if you are making a payment with your extension request.

If you need to make certain changes to your original Maryland return that has already been filed and processed, you must file Form 502X for 2019 to amend your original tax return.
